This position is located in the Office of General Counsel, Office of the Senior Deputy Chairman, National Endowment for the Arts. The National Endowment for the Arts (NEA), is the largest funder of the arts and arts education in communities nationwide and a catalyst of public and private support for the arts. The purpose of this position is to provide professional legal advice to the General Counsel and appropriate agency staff on matters that are often of the utmost confidentiality and urgency.

Duties

Help

  • Rendering legal advice on complex matters pertaining to administrative law, grants and cooperative agreements, contracts, intellectual property, and First Amendment issues.
  • Providing legal guidance on Federal financial assistance programs and transactional instruments, including grantmaking, compliance, and oversight.
  • Reviewing and advising on transactional matters, including contracts, interagency agreements, and grant-related instruments.
  • Advising on appropriations law and the proper use of federal funds
  • Supporting and conducting litigation, including employment and other civil matters, and coordinating with the Department of Justice.
  • Leading efforts to address matters that may evolve into litigation, including developing agency strategy and risk mitigation.
  • Representing the agency in matters before the EEOC, MSPB, CBCA or any other appropriate administrative forum.
  • Negotiating with external entities on intellectual property, contracts and other related matters.
  • Providing legal assistance with NEA responses to Freedom of Information Act (FOIA) and Privacy Act requests, and preparation of FOIA reports and other FOIA-related materials.

Qualifications

Applicants must demonstrate that they meet the Basic Requirements AND Specialized Experience requirements as noted below.

Basic Requirement:
You must be a graduate of a school of law with an LLB or JD accredited by the American Bar Association and be an active member in good standing of the bar of a state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.

In order to qualify for this position, youmust also meet the Specialized Experience Requirement:

Specialized Experience: You qualify for this GS-14 grade level (starting salary $143,913) if you possess at least one year (52 weeks) of specialized experience in the Federal service or equivalent public or private sector experience at a level comparable in scope and responsibility to the GS-13 grade level performing the following duties:

  • Providing Legal Support on Federal Regulatory, Grants and Federal Financial Assistance, Contracts, FOIA, and Administrative Law Matters
  • Providing litigation, supporting litigation, and advising on litigation risk in administrative law
  • Managing employment law matters, including EEO complaints and the EEO process, MSPB matters, employment law litigation and motions practice
  • Interpreting and applying statutory and regulatory requirements to ensure compliance and to mitigate risk
  • Advising and representing organizations on legal issues involving nonprofit entities and/or the First Amendment

Current or Former Political Appointees: The Office of Personnel Management (OPM) must authorize employment offers made to current or former political appointees. Qualifications Must Be Met: The qualification requirements listed above must be met by the 05/06/2026 of this announcement.

Applicants must possess a J.D. Degree, be an active member of the bar (any U.S. jurisdiction), and have at least 1* year post-J.D. legal or other relevant experience. (transcript is required)
