As the incumbent of this position, you will: serve as the Assistant Deputy Director for Civil Rights in the Office of Civil Rights and Equal Employment Opportunity (OCR-EEO), U.S. Department of Energy. The Assistant Deputy Director is the Deputy to the Deputy Director for Civil Rights and Equal Employment Opportunity, for all external civil rights and formal equal employment opportunity (EEO) complaint process matters, and reports to the Deputy Director for Civil Rights and EEO.

As the Assistant Deputy Director for Civil Rights you will:

  • Provide direction to the External Civil Rights Compliance and Enforcement Division and the EEO Formal Complaints Division.
  • Discharge all actions necessary to carry out program responsibilities, including executive oversight, supervision, and guidance related to: formulating and executing external civil rights policies and procedures; adjudicating complaints of discrimination filed against recipients of DOE financial assistance; strategic implementation and scaling of OCR-EEO's external civil rights Pre-Award Pilot Program; deployment of DOE's new Limited English Proficiency Plan for DOE's Program Offices, as well as deployment of post-award compliance reviews of recipients of DOE financial assistance; strategic implementation of the formal EEO complaint process across the DOE enterprise (with the exception of NNSA and BPA), including the notice of acceptance/dismissal stage, investigative phase, hearing stage, final agency decision stage, and appeals stage, as well as settlement and breach of settlement matters; and the preparation and issuance of sound legal documents in the area of internal and external civil rights compliance and enforcement.
  • Direct organizational activities, frame strategic plans based on broad organizational assessments and evaluations of long-term organizational objectives, set internal control standards for effectiveness, efficiency, and productivity and assesses all organizational policy, program, and project viability.
  • Represent the Deputy Director for Civil Rights and EEO with full authority to oversee the management of administrative compliance activities under Titles VI and VII of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Rehabilitation Act of 1973, Age Discrimination Act of 1975, Age Discrimination in Employment Act of 1967, Genetic Information Nondiscrimination Act of 2008, Equal Pay Act of 1963, EEOC Management Directives 715 and 110, and related civil rights statutes, regulations, and Executive Orders.
  • Oversee and direct the internal organization, staffing, policies, and personnel authorities required to carry out the responsibilities of the organization, including the recruitment of senior managers and technical experts necessary to ensure the success of the programs.
  • Serve as an expert legal advisor and make determinations on complex matters involving external civil rights and equal employment opportunity law and related matters.

This is an Excepted Service position. This appointment will not confer Competitive Service career-conditional or career tenure status. This means that if you are selected, you would have to compete with other applicants in open competition to meet requirements for another Federal position, unless you meet the requirements for reinstatement. Applicants who voluntarily convert from the competitive service, Senior Executive Service, or other pay systems to a non-time limited appointment under this excepted service authority are not afforded "fallback rights" to the pay system assigned prior to conversion.

Qualifications

SPECIALIZED EXPERIENCE REQUIREMENTS: A qualified candidate's online application and resume must demonstrate at least one year of specialized experience equivalent to the next lower grade/pay band in the Federal service. For this position, experience must be at least equivalent to the EJ/EK-III or GS-13 level. Specialized experience for this position is defined as:

A graduate of a recognized law school accredited by the American Bar Association, in good standing with the Bar Association of any State, the District of Columbia, or the Commonwealth of Puerto Rico, with an expert knowledge of policies, practices, and procedures under Titles VI and VII of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, the Rehabilitation Act of 1973, Age Discrimination Act of 1975, Age Discrimination in Employment Act of 1967, Genetic Information Nondiscrimination Act of 2008, Equal Pay Act of 1963, EEOC Management Directive 715, EEOC Management Directive 110, and related statutes, regulations, and Executive Orders, which prohibit discrimination within the Federal Government and in programs and activities receiving federal financial assistance or grants.

"Experience" refers to paid and unpaid experience. Examples of qualifying unpaid experience may include: volunteer work done through National Service Programs (such as Peace Corps and AmeriCorps); as well as work for other community-based philanthropic and social organizations. Volunteer work helps build critical competencies, knowledge and skills; and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

Education

Must meet the minimum education requirements of successful completion of a full course of study in a school of law accredited by the American Bar Association (ABA) with a professional law degree (L.L.B or J.D.).
