Duties

Help

The major duties for this position include but are not limited to the following:

  • Supervises a group of investigators, identifying, distributing, and balancing workload and tasks among employees, and making adjustments to accomplish the work in accordance with OSHA's strategic and operational planning priorities and within statutory deadlines.
  • Advises the Assistant Regional Administrator on individual and group performance or conduct issues and makes recommendations for any needed remedial action.
  • Evaluates work performance of subordinates. Gives advice, counsel, or instruction to employees on both work and administrative matters.
  • Participates in and negotiates voluntary settlement agreements relative to whistleblower investigations.
  • Reviews investigative files to ensure the proper applications of investigative protocol, the reasonableness of findings and conclusions, the adequacy of documentation, and to assure that cases are legally sufficient and consistent with OSHA policy and directives.
  • Conducts investigations of the most complex, difficult, or sensitive Whistleblower allegations under the whistleblower protection provisions of applicable statutes.
  • Coordinates investigations with other federal, state, local, or private investigative agencies which may be involved in simultaneous investigations.
  • Works with the Regional Solicitor in developing cases and coordinates hearings for subordinates.
  • Reviews investigative case file materials requested under provisions of the Freedom of Information Act for accuracy, completeness, and appropriateness of disclosure.
  • Identifies deviations and recommends appropriate changes. Makes effective recommendations to the ARA regarding final disposition of complaints.
  • Discusses problem areas and provides guidance and interpretation on the use of legal standards and other regulatory or procedural requirements.

Qualifications

Specialized Experience is the experience that equipped the applicant with the particular knowledge, skills, and abilities (KSA's) to perform the duties of the position successfully, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level.

To qualify for the GS-13: Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level, GS-12. Qualifying specialized experience for the GS-13 includes:

  • Reviewing, analyzing and interpreting OSHA laws to assure compliance with regulations;
  • Reviewing, analyzing, interpreting Whistleblower investigation data to evaluate effectiveness of the Whistleblower Protection Program;
  • Negotiating sensitive situations between Respondents, Complainants, and their representing counsel.

Salary: The salary range indicated in this announcement reflects the lowest and highest potential salaries for this position. You may not be aware, but in the regulations for agency ethics programs, there are requirements for supervisors. Section 2638.103 of Title 5 of the CFR states: Every supervisor in the executive branch has a heightened personal responsibility for advancing government ethics. It is imperative that supervisors serve as models of ethical behavior for subordinates. Supervisors have a responsibility to help ensure that subordinates are aware of their ethical obligations under the Standards of Conduct and that subordinates know how to contact agency ethics officials. Supervisors are also responsible for working with agency ethics officials to help resolve conflicts of interests and enforce government ethics laws and regulations, including those requiring certain employees to file financial disclosure reports. In addition, supervisors are responsible, when requested, for assisting agency ethics officials in evaluating potential conflicts of interest and identifying positions subject to financial disclosure requirements.

Supervisory Financial Disclosure (If applicable): This position is subject to the confidential financial disclosure requirements of the Ethics in Government Act of 1978 (P.L. 95-521). Therefore, if selected, you will be required to complete a Confidential Financial Disclosure Report (OGE Form 450) to determine if a conflict or an appearance of a conflict exists between your financial interest(s) and your prospective position with DOL. This information will be required annually.
