The Equal Employment Opportunity Specialist:

  • Serves as an adjudicator, drafting and reviewing FADs on discrimination complaints filed against DOT by employees or applicants for employment, nationwide.
  • Prepares FADs based on current EEO laws, regulations, and policies.
  • Reviews and analyzes administrative complaint files and investigative reports to determine findings of facts and conclusions of law in the preparation of complex proposed FADs.
  • Researches, analyzes, and interprets EEO laws, case law, regulations, policies, and program guidance as it applies to a wide range of difficult cases; and keeps abreast of the latest trends and developments in EEO complaints adjudication.
  • Collaborates with the Senior Adjudicator(s), DOCR staff, and other agency officials, as appropriate, on adjudicative matters and complaint processing.

The ideal candidate must have subject matter expertise and at least one year of prior substantive experience in interpreting, applying, and explaining the EEO caselaw, statutes, regulations, guidance, and policies. The candidate must have exceptional written and oral communication skills, including experience advising, briefing, and /or training senior managers and leaders and junior division staff. The ideal candidate must maintain confidentiality, and work independently or collaboratively, as required to further the mission.  The candidate must have exceptional time management, prioritization, and organizational skills.

CONDITIONS OF EMPLOYMENT:

  • SELECTIVE SERVICE: Males born after 12/31/1959 must be registered for the Selective Service.
  • GOVERNMENT TRAVEL CARD: This position involves travel.  A government contractor-issued travel card will be issued and must be retained for official business only.
  • PROBATIONARY PERIOD: You must complete a one-year probationary period (unless already completed).
  • TIME-IN-GRADE: Federal applicants must have served 52 weeks at the next lower grade in the competitive or excepted service in the executive branch to satisfy time-in-grade restrictions contained in 5 CFR 300, Subpart F.
  • REMOTE WORK: This position may be eligible for remote work, which does not require reporting to the agency worksite location on a regular basis. If selected for a remote work location, you will be required to sign a remote work agreement detailing agency remote work policy requirements, working conditions, and expectations for the position.

Qualifications

To meet the minimum qualifications for this position, you must meet either the education or experience qualifications for the grade at which you are requesting consideration.

To qualify for the GS-11 on Experience, you must have at least one year of experience equal or equivalent to the GS-09 it must include:

  • Experience with the investigation and adjudication of equal opportunity complaints AND experience analyzing facts, preparing technical reports, and conducting presentations as it relates to equal employment opportunity.
  • Experience applying technical knowledge of EEO principles, laws, and regulations to complaint filings.

To qualify for the GS-11 on Education alone, you must have:
3 years of progressively higher level graduate education leading to a Ph.D. degree or Ph.D. or equivalent doctoral degree.
You can also qualify based on a combination of higher level graduate education and experience. This must be fully supported by your resume and transcripts, provided with your application.

To qualify for the GS-12 on Experience, you must have at least one year of experience equal or equivalent to the GS-11 it must include:

  • Experience applying technical knowledge of EEO principles, laws, and regulations to complaint filings.
  • Experience which includes reviewing and processing discrimination complaints in accordance with applicable policies, laws, and regulations.
  • Experience preparing legal summaries, briefings, or memoranda, and conducting legal research.

You cannot qualify on education at the GS-12 level; you must have experience.

To qualify for the Grade 13, you must have at least one year of experience equal or equivalent to the GS-12, it must include:

  • Experience applying technical knowledge of EEO principles, laws, and regulations to complaint filings.
  • Experience preparing Final Agency Decisions based on current laws, regulations, and policies.

KNOWLEDGE, SKILLS AND ABILITIES (KSAs): Your qualifications will be evaluated on the basis of your level of knowledge, skills, abilities and/or competencies in the following areas:

  1. Labor Law - Knowledge of state and Federal employment laws, regulations, guidelines, and legal precedents related to hiring practices, equal employment opportunity, and wage and hour restrictions.
  2. Attention to Detail - Is thorough when performing work and conscientious about attending to detail.
  3. Legal, Government, and Jurisprudence - Knowledge of laws, legal codes, court procedures, precedents, legal practices and documents, Government regulations, Executive orders, agency rules, Government organization and functions, and the democratic political process.

For all types of consideration, experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social).  Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment.  You will receive credit for all qualifying experience, including volunteer experience
