Help

As the Senior Counsel for Procurement and Cyber Law, you will serve as the administrative and legal expert for the entire United States Patent and Trademark Office (USPTO) in the areas of procurement law and cyber law. You'll also oversee USPTO's procurement litigation in administrative tribunals and federal court.

In this vital role, you'll function as the staff expert and leading advisor on intricate issues associated with a wide range of procurement and cyber law. You'll also supervise and manage a team of talented procurement and cyber law attorneys, and will review and edit attorney-drafted motions, briefs, and other pleadings, manage complex litigation, and coordinate OGL's advice and decisions.

As the Senior Counsel for Procurement and Cyber Law, you will:

  • Review all proposed changes to agency policy and practices based on substantive procurement law, cyber law, and related administrative matters;
  • Develop legal guidelines and agency policy on procurement and cyber law matters;
  • Serve as an advisor to the Deputy General Counsel, General Counsel, and other USPTO managers;
  • Keep abreast of changes in the area of procurement law and cyber law, and the latest developments in other general law areas;
  • Oversee USPTO's procurement and cyber law litigation, and act as principal attorney in the most complex administrative, civil, and appellate litigation. In such cases, you'll be responsible for the complete preparation, litigation, and general conduct of the case, including discovery and management of expert witnesses;
  • Attend meetings on behalf of the Deputy General Counsel, Office of General Law, and occasionally serve as Acting Deputy General Counsel in the absence of the Deputy GC; and handle additional matters as assigned.
This position may include some supervisory and related managerial duties, which should occupy less than 25 percent of the incumbent's time.

Qualifications

Experience must have been at a sufficiently high level of difficulty to clearly show that the candidate possesses the required professional/technical qualifications set forth below.

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

If not already an expert in both subject areas, the selectee for this position will be required to develop expertise in both areas within a reasonable time.

  1. Describe your demonstrated knowledge of practices and policy issues that relate to procurement law (including 5 U.S.C. Chapter 41, the FAR, USPTO's statutory authorities, and the PTAG) and/or cyber law (including FISMA, FITARA, OPEN Government Data Act, and OMB and NIST publications).
  2. Describe your demonstrated ability to oversee and litigate federal court and administrative cases on behalf of the agency that involve procurement law and/or cyber law matters.
  3. Describe your demonstrated ability to lead a team of attorneys and other professionals who implement the agency's procurement law and/or cyber law program and who provide advice to agency clients and oversee related litigation.
  4. Describe your demonstrated ability to work with representatives of other agencies and/or offices to develop joint plans, policies, or procedures in procurement law- and/or cyber law-related areas.

Education

The candidate must have a law degree from an accredited law school program and must be a member of a bar in good standing, in the United States or a Territory of the United States.

Additional information

Probationary Period: If selected, you may be required to serve a two-year probationary period.

This is a Non Bargaining Unit position. This is a Public Trust position and has a risk level designation of "high".
