Duties

The CRLM Division provides a wide range of legal services to various agencies within the Department of Labor. In particular, the CRLM Division provides legal services to the Office of Federal Contract Compliance Programs in enforcement, policy, and rulemaking regarding the equal employment opportunity (EEO) obligations of federal contractors and subcontractors arising under Executive Order 11246, Section 503 of the Rehabilitation Act of 1973, and the Vietnam Era Veterans' Readjustment Assistance Act of 1974. The Division also provides a broad range of legal services, including advice, litigation, and rulemaking, to the Office of Labor-Management Standards concerning the administration and enforcement of the Labor-Management Reporting and Disclosure Act of 1959 and related statutes which, among other things, promote democratic procedures within unions.  The Division also provides legal services to the Civil Rights Center on matters arising under Section 188 of the Workforce Innovation and Opportunity Act and other nondiscrimination statutes applicable to recipients of DOL financial assistance, as well as on internal EEO cases and related matters. Additionally, the Division provides legal services to the Office of Apprenticeship regarding EEO matters arising in registered apprenticeship programs; the Office of Disability Employment Policy; the Women's Bureau, the Center for Faith-Based and Neighborhood Partnerships; and the Veterans' Employment and Training Service.

This position has promotion potential to GS-14.  Promotion Potential:  There is no obligation to provide future promotions to you if you are selected. Future promotions are dependent on your ability to perform the duties at a higher level, the continuing need for an employee assigned to the higher level, and supervisory approval.

The incumbent provides the full range of legal services in connection with the administration and enforcement of the laws assigned to the Division. In this respect, the incumbent provides legal advice to appropriate agency officials, attorneys in Regional Solicitors' Offices, and the public, as requested, concerning the application and interpretation of the provisions of the above-referenced statutes.

The incumbent will work under the general supervision of a Division Counsel. The incumbent is responsible for handling a large and varied workload of legal advice, litigation and rulemaking projects within the CRLM Division. Assigned litigation involves large or complex cases, possibly in partnership with other Division attorneys, a Regional Solicitor’s Office, or the Department of Justice (DOJ). The incumbent prepares legal analyses assessing the litigation-worthiness of investigative case files referred for litigation and makes recommendations to a CRLM Division Counsel whether to file suit; prepares pleadings and memoranda; participates in or coordinates client agency investigations; and may represent the Department at all phases of pre-trial discovery and motion hearings, and at the trial itself. In addition, the incumbent performs appellate duties, sometimes with DOJ, and works with DOJ in defensive cases challenging final agency actions. The incumbent works with Division attorneys and the client to draft and review rulemaking documents and provides advice on relevant issues of administrative law. The incumbent also interacts with client agency personnel and may represent the Division on matters assigned to him/her.

The incumbent analyzes legislative materials and correspondence received by the Department to determine whether they raise issues under the statutes for which the Division is responsible, and reviews or drafts proposed responses, as necessary. The incumbent reviews interpretations, opinions, guidance documents, and rulings prepared by the agencies dealing with important, and often complex, issues.

This position is excluded from the bargaining unit.

Qualifications

To qualify for an attorney position, applicants must possess a professional law degree (LL.B. or J.D.); be a member in good standing of the bar of a court of general jurisdiction of a state, territory or possession of the U.S.; and have acquired the amount of experience indicated below for each grade level.

GS-12, one (1) year of progressively responsible legal experience of a professional nature which demonstrates the ability to perform the work at this level. The one year of qualifying experience, at this level, must also be specialized experience as defined below.

GS-13, two (2) years of progressively responsible legal experience of a professional nature which demonstrates the ability to perform the work at this level. At least one year of qualifying experience, at this level, must be specialized experience as defined below. 

Specialized experience, for this grade level, is experience reflecting knowledge of Federal civil rights and labor-management laws, including Titles VI and/or VII of the 1964 Civil Rights Act, Title IX of the 1972 Education Amendments, Executive Order 11246, the Americans with Disabilities Act, the Rehabilitation Act, the Labor-Management Reporting and Disclosure Act, the National Labor Relations Act, and/or  the Railway Labor Act; and other pertinent federal statutes such as the Administrative Procedure Act,

Note:  An LL.M. may be substituted for a maximum of one year experience.

2. Demonstrated ability to conduct thorough and efficient legal research and analysis, and to prepare well-reasoned, accurate, concise, well-organized, and persuasive legal documents, including legal memoranda, motions, agency decisions, briefs, pleadings, federal register notices, and correspondence;

3. Demonstrated ability to make effective and accurate oral presentations in a clear, concise manner;

4. Demonstrated commitment to government service or public interest law, as reflected in coursework, prior experience in government, clinics, nonprofit, volunteer, or similar activities.

5. Prior relevant experience including litigation (moot courts or clinical programs; motions practice; drafting pleadings, briefs, or decisions; preparing appellate briefs; etc.), negotiations, rulemaking, policy or advice work, and/or conducting training.
