Duties

Help

This position is located in the Division of Occupational Safety and Health within the National Office of the Solicitor of Labor (SOL). The Division is responsible for the legal work arising out of the Department's administration and enforcement of the Occupational Safety and Health Act of 1970 (OSH Act) as amended, and the anti-retaliations provisions of several other statutes. This includes providing legal advice to Department officials; assisting in litigation by the SOL field offices; conducting litigation before the Occupational Safety and Health Review Commission and federal district and appellate courts; providing legal services in connection with rulemakings related to safety and health standards and regulations; representing the Department vis-à-vis other Federal agencies, the legislative branch, states, private sector groups, and members of the public; reviewing state plans; and providing legal services in connection with OSHA's voluntary programs and compliance assistance efforts.

The General Attorney works in the OSH Division under the direction of the Counsels for Standards, Legal Advice, Enforcement and Regional Litigation, Special Litigation, or Appellate Litigation, as appropriate. The General Attorney assists the Counsels for Standards by providing legal advice to OSHA in connection with the development and promulgation of occupational safety and health standards, regulations, and guidance documents. The General Attorney also works with the Counsel for Legal Advice to support important OSHA programs, such as State Plans and the Whistleblower Protection Program, and works with the Counsel for Enforcement and Regional Litigation to provide advice in OSH Act litigation arising in SOL field offices and to advise OSHA in the development of key policy and enforcement initiatives. For the Counsel for Special Litigation, the General Attorney works on designated large or complex litigation matters that are coordinated by the National Office.  In addition, the General Attorney assists the Counsels for Appellate Litigation on difficult and sensitive appellate cases by analyzing factual and legal issues, drafting pleadings and briefs, making recommendations to senior attorneys regarding conflicting or novel opinions of law, evidentiary matters, and court procedure, and representing the Secretary of Labor in oral arguments before the Occupational Safety and Health Review Commission and the federal courts of appeals. The complexity of the work and the degree of independence expected of the General Attorney increase from the GS-12 to the GS-14 level.

Qualifications

To qualify for an attorney position, applicants must possess a professional law degree (LL.B. or J.D.); be a member in good standing of the bar of a court of general jurisdiction of a state, territory or possession of the U.S.; and have acquired the amount of experience indicated below for each grade level.

GS-12, applicants must possess one (1) year of progressively responsible legal experience of a professional nature which demonstrates the ability to perform the work at this level.

GS-13, applicants must possess two (2) years of progressively responsible legal experience of a professional nature which demonstrates the ability to perform the work at this level.

GS-14, applicants must possess three (3) years of progressively responsible legal experience of a professional nature which demonstrates the ability to perform the work at this level. At least one year of qualifying experience, at this level, must be specialized experience as defined below:

Specialized experience for this grade level, is legal work, such as researching and analyzing issues, drafting legal memoranda or briefs, and advising clients, that is performed with a higher degree of independence. Experience with legal work involving occupational safety and health issues or related matters would be an advantage but is not necessary.

Education

Any applicant falsely claiming an academic degree from an accredited school will be subject to actions ranging from disqualification from federal employment to removal from federal service.

Evaluation Factors: 

  1. Demonstrated skill in researching and preparing well-written, organized, and persuasive legal documents, including briefs and other pleadings, memoranda, regulations, guidance documents, settlement agreements, and correspondence.
  2. Ability to make effective oral presentations in a clear and concise manner.
  3. Ability to advise clients and establish and maintain effective working relationships with high-level departmental officials, regional program officials, supervisors, agency staff and the general public.
  4. Ability to multi-task in a complex and fast-paced inter-disciplinary legal environment, entailing timely collections of facts, identification and resolution of issues, enumeration of options, and formulation of recommendations.
  5. Prior experience relevant to the position, particularly experience litigating cases at the trial or appellate level, developing and promulgating federal regulations and related documents, and providing legal advice. Such experience is not required but would be considered positively.
