Case Development

In conjunction with the Clerk of the Board, the incumbent develops and implements methods, processes, and procedures for preliminary case review, analysis, development, and referral (or dismissal) of cases within the office. Evaluates adequacy of existing systems and processes in handling case workload and develops or recommends changes to ensure that cases filed within the Boards are processed timely in accord with applicable legal regulations and procedures; that legal motions and documents received are reviewed, acknowledged, and processed within specific legal and Board time frames; that required legal orders are issued; and that cases are remanded to lower administrative courts as appropriate.

Performs continual oversight, monitoring, and evaluation of day-to-day activities of the staff to assure smooth workflow and operations in accord with legal and regulatory requirements, and office production and quality objectives and standards.

Reviews and evaluates completed work of subordinates as necessary to ensure legal consistency within the office in accordance with guidelines and procedures established by the Office Director; and to ensure that cases are fully developed and complete before assignment to attorney staff.

Preparation And Processing Of Motions And Orders.

Oversees the determination, suitability, and adequacy of motions. Oversees communication with claimants or agencies that need assistance with providing adequate or timely documentation. Provides technical direction to staff so that improperly filed motions and orders are forwarded to the correct legal body or returned to the claimant with recommendations for submission.

Research and Analysis

Provides technical direction to subordinate specialists' application of case law and draft sections of Board decisions in “pro forma” cases. Analyzes claims, including petitions for reconsideration and attorney fee requests and motions. Reviews summaries of Board decisions and orders for distribution to attorneys. Reviews subordinate specialists' determinations of the acceptability of claims, and materials in support of those claims.

Finalizes draft responses to Congressional, Freedom of Information Act (FOIA), and similar inquires.

You may not be aware, but in the regulations for agency ethics programs, there are requirements for supervisors. Section 2638.103 of Title 5 of the CFR states:

Every supervisor in the executive branch has a heightened personal responsibility for advancing government ethics. It is imperative that supervisors serve as models of ethical behavior for subordinates. Supervisors have a responsibility to help ensure that subordinates are aware of their ethical obligations under the Standards of Conduct and that subordinates know how to contact agency ethics officials. Supervisors are also responsible for working with agency ethics officials to help resolve conflicts of interests and enforce government ethics laws and regulations, including those requiring certain employees to file financial disclosure reports. In addition, supervisors are responsible, when requested, for assisting agency ethics officials in evaluating potential conflicts of interest and identifying positions subject to financial disclosure requirements.

Applicants must meet time-in-grade, time-after-competitive-appointment and qualifications requirements within 30 calendar days after the closing date of the vacancy to be eligible for consideration for selection.

Qualifications

Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level, GS-11, in the Federal Service.

Specialized experience is defined as experience providing legal support that should include analyzing case documentation; researching factual and legal issues; and assisting in the preparation of motions, orders, and other legal actions.

Education

There's no education substitute for experience at the GS-12 level.
