Major Duties: This is not an all-inclusive list
A ATTORNEY-ADVISER (GENERAL), GS-0905-13,
1) Acts as a legal adviser and attorney for the state/territory National Guard, responsible for the formulation of state/territory legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law; international law and treaty agreements; trial defense; and a full spectrum of expert legal advice.
(2) Responsible to advise on the legal, factual and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, or opinions with emerging or highly conflicted and emotionally charged issues such as intelligence oversight related to Homeland Security, or advising on Federal and state/territory Executive Orders for the use of federalized troops in response to domestic emergencies and natural disasters.
(3) Serves as the state/territory National Guard litigation point of contact. Represents the state/territory National Guard in all legal matters in state/territory and Federal courts of original or appellate jurisdictions. The incumbent seeks to prevent avoidable litigation, but may serve as Special Assistant to the U.S. Attorney or Assistant Attorney General at trial as cases dictate. The incumbent conducts investigations of fact and legal sufficiency; advising on administrative remedies; develops the trial strategy, content and means of presentation, and trial delivery; makes motions; and conducts post-trial duties. Prepares litigation reports, briefs, pleadings and other papers associated with litigation involving the state/territory National Guard interests.
(4) Serves as an attorney/adviser providing acquisition and fiscal legal advice to the state/territory's assigned United States Property & Fiscal Officer (the Chief of the National Guard Bureau's agent in the state/territory) and active duty military advisers. Advises Army National Guard (ARNG) and Air National Guard (ANG) contracting officers, reviews contracts, procurement actions and real property matters involving Federal and state/territory funds (some involving substantial amounts of money) for legal sufficiency, appropriate titling and claim initiation or resolution actions. Provides advice and legal assistance in bid protest matters and represents the National Guard in disputes before fiscal and contract administrative and judicial forums.
(5) Acts as the Adjutant General's representative in third-party proceedings under Federal labor-management and equal employment opportunity statutes and regulatory provisions. Represents the state/territory National Guard as a trial attorney on assigned cases before investigators, administrative judges and arbitrators from various appellate bodies including, but limited to, the Equal Employment Opportunity Commission, the Federal Labor Relations Authority, the Federal Services Impasses Panel and Federal Courts.
(6) Advises the convening authorities, including the state/territory Adjutant General, on procedural and legal issues associated with Courts Martial, Non-Judicial Punishment, Administrative Board proceedings and subsequent actions.
Performs other duties as required.
CONDITIONS OF EMPLOYMENT
EDUCATION: It is mandatory to have a Bachelor of Laws or Juris Doctor degree in law issued by an an ABA- accredited law school; and, must be admitted to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia.

Area 1: Current On-board Minnesota National Guard Title 32 Technicians who are in permanent or indefinite technician status as a result of being competitively hired within that National Guard component applying for a position within the component which they are currently employed.
Area 2: Current Minnesota National Guard Title 32 Technicians who are in permanent or indefinite technician status as a result of being competitively hired at a sister component that is identified on the Position Vacancy Announcement (PVA), including onboard Title 5 employees that are also current members of MNNG; i.e. Army MNNG to Air MNNG, Air MNNG to Army MNNG.
Area 3: All Minnesota National Guard members currently assigned to the MNANG or to the MNARNG applying for a position within the component in which they are currently assigned. i.e. temporary technician or Traditional Guardsman.
Area 4: Currently assigned service members in other branches of the military outside of the Minnesota National Guard, to include those assigned to Active Duty, Reserve or other state's National Guard.
Area 5: All individuals able to and willing to become members of the Minnesota National Guard including prior service not currently assigned to a military component and non-prior service US civilians.
Evaluation Factors: Candidates will be evaluated on the basis of appropriate education, experience, training, self-development activities, and special awards. Candidates are considered on the basis of available information on their current application and supporting information that has been provided to this office. To ensure full consideration, applicants are urged to submit information about their training, self-development, outside experience, activities and awards. National Guard military (Part-time) service is considered as full-time experience when evaluated against the qualification requirements for a technician position. The applicant is credited with actual number of months the member has been in the National Guard if the experience is related.
