Summary

The Department of Labor, Office of Inspector General (OIG) is an independent oversight agency authorized by the IG Act to conduct audits, investigations, and other work related to DOL’s programs and operations. This position serves as the Deputy Counsel in the Office of Legal Services (OLS).  The mission of the OLS is to formulate, coordinate, and administer a comprehensive and integrated legal support program for all OIG field components and headquarters operations.

Duties

Help

As Deputy Counsel and legal advisor to the Counsel to the IG, furnishes expert legal advice, assistance and services to the Office of inspector General.

Supervise and manage the delivery of services by the Office of Legal Services (OLS),  which includes 6 staff attorneys, an information disclosure officer, a records management officer, and contract personnel.

Deliver and supervise legal services on the most complex, sensitive, or high-profile matters covering a broad range of matters arising under and related to the OIG's mission under the IG Act and related laws, including work that supports audits, inspections, investigations, and whistle blower protection, information disclosure (FOIA/PA) and records management. Legal services include issues involving fiscal law, federal procurement and grant law, law enforcement, and programs and operations affecting the Department of Labor.

Deliver and manage delivery of representational services in complex administrative litigation before the Equal Employment Opportunity Commission (EEOC), Merit Systems Protection Board (MSPB), Office of Special Counsel (OSC) and other forums as required. Provides expert advice related to civilian personnel law, including EEOC, MSPB, and OSC.

Supervise OIG's Information Disclosure Program, Freedom of Information Act, Privacy Act programs and Records Management program.

Work effectively with senior OIG and government officials, intergovernmental counsel, legislative aides, and members of the public, as needed.

NOTE REGARDING ETHICAL OBLIGATIONS: Section 2638.103 of Title 5 of the CFR provides:

Every supervisor in the executive branch has a heightened personal responsibility for advancing government ethics. It is imperative that supervisors serve as models of ethical behavior for subordinates. Supervisors have a responsibility to help ensure that subordinates are aware of their ethical obligations under the Standards of Conduct and that subordinates know how to contact agency ethics officials. Supervisors are also responsible for working with agency ethics officials to help resolve conflicts of interests and enforce government ethics laws and regulations, including those requiring certain employees to file financial disclosure reports. In addition, supervisors are responsible, when requested, for assisting agency ethics officials in evaluating potential conflicts of interest and identifying positions subject to financial disclosure requirements.

Notification Concerning COVID-19 Vaccinations.  As required by Executive Order 14043, Federal executive branch employees are required to be fully vaccinated against COVID-19 regardless of the employee's duty location or work arrangement (e.g., telework, remote work, etc.), subject to such exceptions as required by law.  If selected, you will be required to be vaccinated against COVID-19 and to submit documentation of proof of vaccination or to be in the process of requesting an exception to the vaccination requirement before appointment or onboarding with the agency.  The agency will provide additional information regarding which forms of documentation can be accepted and how you can request to be considered for a legally required exception from this requirement.  

Currently, implementation and enforcement of Executive Order 14043 has been suspended pursuant to an injunction pending further litigation.

Due to COVID-19, the agency is currently in an expanded telework posture. If selected, you may be expected to temporarily telework, even if your home is located outside the local commuting area. Once employees are permitted to return to the office, you will be expected to report, within 30 days, to the duty station offered to you in your offer letter.  At that time, you may be eligible to request to continue to telework under the terms of the Agency’s telework policy.

Qualifications

To qualify for an attorney position, applicants must possess a professional law degree (LL.B. or J.D.); be a member in good standing of the bar of a court of general jurisdiction of a state, territory or possession of the U.S.; and have acquired the amount of experience indicated below. 

Applicants must also possess at least seven years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. At least one year of that experience must be specialized experience at or equivalent to the GS-14 grade level in the Federal Service.  

Specialized experience includes the following:

  1. Experience providing authoritative guidance, interpretation and recommendations on both administrative matters and legal issues based on relevant laws and regulations;
  2. Experience advising and representing agencies or private employers in employment law and equal employment law matters;
  3. Experience providing legal advice and guidance on difficult and novel factual and legal issues; and
  4. Experience supervising or leading the work of attorneys who work in representational and advisory capacities.

Note: An LL.M may be substituted for a maximum of one year experience.

Writing Sample: A writing sample showing your ability to clearly analyze legal issues and/or facts is required along with your resume. The sample must be no more than 10 pages, double spaced. 

This position will not be filled until the Department's Placement Assistance Programs have been fully utilized.
