Summary

This position is located in the Office of Exemption Determinations (OED), Division of Individual Exemptions, which is a major component of the Employee Benefits Security Administration (EBSA). EBSA is responsible for administering and securing compliance with the Employee Retirement Income Security Act of 1974 (ERISA) and the Internal Revenue Code of 1986 (the Code) and similar provisions of the Federal Employees' Retirement System Act (FERSA).

Duties

Help

Provides technical advice, either orally or in writing, to other OED and EBSA personnel, plan administrators, participants, special interest groups, Congressional staff, and the general public regarding the disposition of specific applications for exemption or EXPRO submissions, or the procedural requirements for filing exemption applications and EXPRO submissions.

Maintains contact with designated individuals in other Federal agencies to furnish, technical guidance, assistance, or interpretive guidance regarding the exemption provisions of ERISA, the Code, and FERSA, and to discuss and resolve problems of mutual concern.

Reviews analyzes and develops applications for individual exemptions and EXPRO submissions. Formulates recommendations for consideration by supervisor and/or senior Agency officials. Prepares proposed and final exemptions, ensuring consistency with precedent and guidelines. Discusses recommendations with supervisor and/or Agency officials with respect to the resolution of EXPRO submissions.

Reviews and analyzes factual, regulatory, and policy issues raised by the regulatory, legislative, policy, and exemption initiatives proposed or taken by other Federal agencies to assess their impact on the provisions of ERISA and FERSA and on exemptions already issued and proposed.

You may not be aware, but in the regulations for agency ethics programs, there are requirements for supervisors. Section 2638.103 of Title 5 of the CFR states:

Every supervisor in the executive branch has a heightened personal responsibility for advancing government ethics. It is imperative that supervisors serve as models of ethical behavior for subordinates. Supervisors have a responsibility to help ensure that subordinates are aware of their ethical obligations under the Standards of Conduct and that subordinates know how to contact agency ethics officials. Supervisors are also responsible for working with agency ethics officials to help resolve conflicts of interests and enforce government ethics laws and regulations, including those requiring certain employees to file financial disclosure reports. In addition, supervisors are responsible, when requested, for assisting agency ethics officials in evaluating potential conflicts of interest and identifying positions subject to financial disclosure requirements.

Notification Concerning COVID-19 Vaccinations.  As required by Executive Order 14043, Federal executive branch employees are required to be fully vaccinated against COVID-19 regardless of the employee's duty location or work arrangement (e.g., telework, remote work, etc.), subject to such exceptions as required by law.  If selected, you will be required to be vaccinated against COVID-19 and to submit documentation of proof of vaccination or to be in the process of requesting an exception to the vaccination requirement before appointment or onboarding with the agency.  The agency will provide additional information regarding which forms of documentation can be accepted and how you can request to be considered for a legally required exception from this requirement.

Currently, implementation and enforcement of Executive Order 14043 has been suspended pursuant to an injunction pending further litigation.

Qualifications

Applicants must have 1 year of specialized experience equivalent to at least the next lower grade level in the Federal Service.  Specialized experience is experience in or directly related to the position to be filled and which has equipped the applicant with the particular knowledge, skills, and abilities to successfully perform the duties of the position.

For the GS-14 level, Applicants must possess 1 year of specialized experience at a level of difficulty and responsibility equivalent to the GS-13 in the Federal Service.

Specialized experience: 

Analysis and application of fiduciary reporting and disclosure, bonding, funding, vesting, administration, and termination provisions of the Employee Retirement Income Security Act (ERISA) and related laws, regulations, court decisions, and precedent rulings; Development of proposals for new or revised pension or welfare plans, petitions for exemptions, or requests for rulings under governing law; Legal work, a substantial portion of which required interpretation of Federal laws and legal requirements concerning welfare and pension plans, or in such related fields as taxation, securities, real estate, corporations, trusts, bankruptcy, and investments; Auditing or accounting work that involved determining compliance with Federal and State laws governing welfare and pension plans, securities, banking, insurance, or corporations; Analysis of Federal laws or regulations, development of policy, and drafting of proposed changes in an employee welfare and benefit plan or a related function.

Education

There is no educational substitution for specialized experience for this position at the GS-14 level.
