Summary

The Deputy Assistant Chief Counsel for Enforcement provides direction to the field element of the FAA’s Enforcement Division. The incumbent oversees the processing of enforcement cases generated by client offices. The incumbent executes these duties and responsibilities supported by a geographically-dispersed organization consisting of 6 managers at the L-band level who supervise teams of attorneys and support professionals who carry out enforcement-related duties.

Duties

Help

Directs the planning and execution of all legal aspects related to the timely processing of enforcement actions in accordance with statutory and regulatory requirements and Office of the Chief Counsel timelines, goals, and metrics. Assists with legal sufficiency review of programs and policies so that program activities are consistent with the priorities of the FAA Administrator and Chief Counsel.

Provides central leadership, direction, and oversight of the day-to-day management and operation of the Enforcement Division field element by ensuring a consistent approach to recurrent legal matters throughout organizations. Ensures the work performed is aligned with both long- and short-term FAA plans and objectives; communicates the vision, goals, and objectives of the Assistant Chief Counsel for Enforcement to staff; and establishes priorities that align with those goals.

Applies advanced knowledge of the technical aspects of the work directed to include expertise with enforcement and regulatory compliance, advanced knowledge of budget, human resources, and other administrative policies and procedures, and an advanced understanding of the objectives of the major subdivision. Often personally deals with the most complex legal matters within the organization directed. Is actively involved in both long-term and immediate operations of the organization, assisting, and guiding subordinates as needed. Shares responsibility with higher-level managers for developing and executing plans, policies, procedures, and programs.

Oversees all legal aspects of FAA’s enforcement programs in the field, including litigation, training, policy direction, and evaluation of services. Additionally, oversees the timely preparation, initiation, prosecution, and resolution of legal enforcement matters referred by client offices including the Flight Standards Service, Aircraft Certification Service, Office of Aerospace Medicine, Office of Security & Hazardous Materials Safety, Office of Airports, and the Office of Commercial Space Transportation.

Implements the legal aspects of regulatory enforcement, related strategic and organizational initiatives, and goals to include tracking and monitoring their completion. Directs expert legal advice regarding all aspects of Agency policies relating to enforcement and regulatory compliance. With the Assistant Chief Counsel for Enforcement, establishes objectives and strategies for subordinates in support of the enforcement and regulatory compliance goals of the FAA. Directs the work of subordinate managers and staff attorneys.

Assigns tasks and responsibilities to subordinate managers. Monitors and evaluates the performance of subordinate staff. Makes conclusive personnel decisions affecting subordinates. Managerial responsibilities typically affect a substantial number of employees and managers. Managerial duties include the following: develops and executes plans, policies, and programs; sets priorities; assigns work to subordinates; coaches and develops employee capabilities; rates the performance of subordinates; approves leave; and takes, recommends, or approves disciplinary and corrective actions that involve subordinates. Approves substantive personnel actions, such as selections and promotions, involving employees. Defines and organizes staff and work so as to accomplish objectives and meet performance measures, and identifies and evaluates opportunities for operational efficiencies and/or cost savings.

Defines, acquires, and allocates budget, staff, and other resources in coordination with the Assistant Chief Counsel for Enforcement. Manages assigned resources and reallocates resources and workload as necessary to accomplish critical agency and office objectives.

Qualifications

To qualify for this position, ALL applicants MUST meet the following criteria:

(1) have a JD Degree from an accredited law school;

(2) be admitted to practice before the bar of any U.S. jurisdiction or within the District of Columbia;

(3) be an active member of that bar; AND

(4) demonstrate at least one year (52 weeks) of SPECIALIZED EXPERIENCE equivalent to the next lower grade/pay band (FG/GS-14/15 or FV-J/K) that is typically related to the line of work of the position to be filled and which has equipped the applicant with the particular knowledge, skills, and abilities required to successfully perform the duties of the position. To be creditable, specialized experience must have been at least equivalent to the next lower level in the normal line of progression for the occupation in the organization

SPECIALIZED EXPERIENCE is defined as:

  • experience directing and executing plans, programs, policies, or projects in a professional or legal environment;
  • experience handling complex enforcement cases and litigation before administrative or judicial forums; and
  • experience in handling enforcement and legal policy issues.

Contacts are primarily with peers, higher-level managers in AGC, and high-level regional, center, and headquarters managers to discuss the status of programs, projects, and cases and to develop plans for the future. Interacts with executives and other officials within the FAA, the Department of Transportation, Department of Justice, other Federal agencies, and the private sector. The incumbent serves as a subject-matter expert on enforcement and regulatory compliance, and provides advice and counsel to field office management and staff in support of enforcement practice activities.

The Deputy Assistant Chief Counsel for Enforcement reports directly to the Assistant Chief Counsel for Enforcement, who provides broad policy direction. Otherwise, the incumbent takes actions, directs subordinates, and acts independently under authority delegated by the Assistant Chief Counsel for Enforcement. During periods of absence, serves as Acting Assistant Chief Counsel for Enforcement.
