The incumbent serves as a Counseling and Mediation Specialist and is responsible for EEO counseling, mediation, coordination with unions, and investigations of allegations of discrimination associated with the Library's employment discrimination complaint processing program. The incumbent coordinates work performed by contractors and serves as an ombudsman, negotiator, or conflict analyst as appropriate.

Is responsible for complaints and disputes that involve a large body of interrelated facts, many sources of information, many disputed and/or hidden facts, and undefined issues or questions. The incumbent provides EEO counseling, mediation and investigations on non-routine cases or issues for employees with disputes, and who believe that they have been discriminated against.

Explains EEO complaint procedures, including grounds for complaint and the complainant's rights. Negotiates on procedural points, conducts formal interviews of witnesses or other persons having information essential to a complaint case, or persuades individuals. Processes discrimination complaints in accordance with EEO regulations. Takes appropriate actions to ensure that all cases are processed in a timely manner in accordance with technical and regulation requirements.

Incumbent establishes goals and measures for counseling, investigations, and mediation that are linked to the Library's strategic workforce goal. Assists with creating action plans for complaints processing as strategic initiatives. Provides guidance in establishing information management systems for managing, tracking, and providing reliable and consistent reporting of EEO complaints at various stages of processing. Conducts assessments of performance data, (i.e., number of cases; types of issues and bases; status of cases; average processing time for each stage of the complaint process, complaint closure types according to dismissal, withdrawals, settlements, and final agency decisions; and number of employees who only seek advice). Identifies issues and problems and recommends corrective action to Library manager's, supervisors, and labor organizations.

Gathers data using various methods, techniques, and surveys; conducts complicated analysis of information often requiring an evaluation of the impact of changes in legislative and regulatory requirements and conflicting program goals; and presents recommendations to management.

Plans and directs day-to-day program activities in an established equal employment opportunity program oriented toward solving individual complaints of varying complexity.

Reviews, analyzes, and develops new EEO procedures, policies, and guidelines, working closely with the EEO/DP Director, senior managers and counselors. Participates in the review of policy and case background on discrimination complaints, and in the review of administrative policies and programs in order to overcome the under-representation of a specific targeted group, such as Hispanics.

Provides managers and employees with information and interpretation of the Library of Congress's EEO policies. Makes recommendation on methods for developing formal plan(s) to enhance the employment opportunities of targeted groups. 

Analyzes changes to procedures, policies, and regulation for their impact on EEO programs. Suggests actions to correct any deficiencies identified by the reviews. Performs a thorough analysis of The Library of Congress policies and practices that inhibit the employment opportunities of under-represented groups. Identifies specific barriers that exist throughout the organization and suggest solutions to eliminate the barriers.

Offers advice and guidance when procedures and policy changes are implemented, suggesting methods for determining specific impacts within the organization.

Provides managers and employees with information and interpretations of The Library of Congress's EEO and dispute resolution procedures, policies and guidelines when issues addressed are of moderate difficulty and require the interpretation and adaption of regulations and guidelines. For instance, advises line and staff managers on problems affecting the promotion, development, training, and recruitment of under-represented ethnic groups.

Provides information and/or briefs management and union officials on EEO programs. Ensures that information communicates The Library of Congress policy and regulatory requirement. Prepares case analysis in response to grievances. Advises management of potential problems and recommends solutions that are appropriate for resolving the case.

Qualifications

Applicants must have had progressively responsible experience and training sufficient in scope and quality to furnish them with an acceptable level of the following knowledge, skills, and abilities to perform the duties of the position without more than normal supervision.

Ability to apply knowledge of Alternative Dispute Resolution (ADR), EEO, ADA, and other non-discrimination laws, regulations, and guidelines as pertaining to Federal sector employment.**

Ability to conduct EEO counseling or mediation.**

Ability to conduct EEO investigations.**

Ability to develop and interpret EEO policies and guidelines for an organization.

Ability to communicate in writing.

Ability to communicate effectively other than in writing.

Although it is the Library's policy to afford the maximum pay benefit to employees when setting rates of pay, a new appointee who has had no previous Federal service will generally be paid the minimum step of the grade.
