About the Office

The mission of the National Security Division (NSD) is to coordinate the Department of Justice's (DOJ's) efforts in carrying out its core mission of combating terrorism and protecting national security, including protecting our national assets from state-sponsored threats to the private sector. NSD is responsible for supervising the enforcement of all federal criminal laws related to counterterrorism and counterespionage, except those specifically assigned to other divisions. NSD also serves as DOJ's liaison to the United States Intelligence Community (USIC) and represents the government and the USIC before the Foreign Intelligence Surveillance Court. NSD advises the Attorney General regarding all matters of national security policy.
The position requires mastery of the legal profession, is expected to apply novel legal theories to issues; to make decisions or recommendations that significantly change, interpret, or develop important public policies or programs; and to serve as a recognized expert in a given specialty area.

NSD's Foreign Investment Review Section (FIRS) is responsible for DOJ's non-prosecutorial efforts to proactively address national security risks to cross-border transactions and technology posed by foreign adversaries, hybrid commercial threats, and other threat actors.
These efforts span a range of case-specific and general authorities relating to inbound and outbound foreign investments, telecommunications, data security, and the information and communications technology and services (ICTS) supply chain, including the following:
- Foreign investment. FIRS serves as DOJ's representative on the Committee on Foreign Investment in the United States (CFIUS), an interagency group that reviews foreign investments in, acquisitions of, and other transactions involving U.S. companies to determine the transaction's effects on national security.
- Telecommunications. FIRS carries out the Attorney General's responsibilities as Chair of the Committee for the Assessment of Foreign Participation in the United States Telecommunications Services Sector (also known as Team Telecom), an interagency group that makes recommendations to the Federal Communications Commission on how to address any national security and law enforcement risks posed by licenses and authorizations for telecommunications infrastructure, services, and equipment.
- Compliance and enforcement. FIRS develops, drafts, and negotiates National Security Agreements and Letters of Assurance to mitigate national security risks, and monitors, supervises, and enforces the transaction parties' compliance with their National Security Agreements with DOJ.
- Supply-chain security. FIRS investigates foreign-sourced technology and services, and their underlying global supply chains, for national security risks. When FIRS identifies a risk, FIRS refers the technology or service for potential action to, and otherwise works closely with and supports, other agencies or interagency bodies with information and communications technology and services (ICTS) supply-chain-security authorities, including the Department of Commerce's authority under Executive Orders 13873 and 14034, the Federal Acquisition Security Council (FASC), the FCC's Covered List under the Secure and Trusted Communications Act, and others.

Job Description

To implement the President's America First Investment Policy by representing the Department of Justice on the Committee on Foreign Investment in the United States (CFIUS), discharge the Attorney General's responsibilities as chair of the Committee for the Assessment of Foreign Participation in the U.S. Telecom Services Sector (Team Telecom), execute the policies of E.O.13913, as well as respond to the ICTS supply chain national emergency President Trump declared in Executive Order 13873, and deliver on promises made by President Trump in his America First Investment Policy and NSPM-2 on Imposing Maximum Pressure on Iran, FIRS is seeking line attorneys who will:
- Analyze and evaluate the risk to national security and law enforcement posed by foreign involvement in U.S. businesses in connection with investigations for CFIUS, Team Telecom, and compliance and enforcement of mitigation agreements;
- Draft risk assessments sourced from sensitive and classified information in support of the President's America First Investment Policy;
- Coordinate interagency reviews and responses to potential threats to sensitive national security matters related to foreign investment;
- Negotiate and monitor complex compliance with national security commitments, and pursue enforcement actions for noncompliance when warranted;
- Evaluate emerging technologies to determine any national security or law enforcement risks posed by foreign activity involving that technology; and
- Personally volunteers for Department-wide initiatives, special projects, Division-initiatives and performs other duties as assigned.

Conditions of employment

• You must be a United States Citizen or National.
• You will be required to complete a pre-employment security investigation and background check which includes a drug screening.

• Selective Service registration is required for males born on, or after, December 31st 1959. Those not registered should have an approved exemption on file.

Qualifications

Applicants must possess a J.D. degree, be duly licensed and authorized to practice as an attorney under the laws of a State, Territory, or the District of Columbia, and have at least two or more years of post-J.D. professional experience. Applicants must have superior academic credentials, possess excellent analytical and writing skills, and have the dedication and capacity to work independently in a very demanding environment. Past experience in the national security or intelligence fi eld is not required but is preferred. Prior federal litigation experience is also strongly preferred.
Must be able to meet JMD and NSD suitability criteria for this position.
Must be able to obtain and maintain a TOP SECRET/SCI security clearance.
Failure to obtain or retain this level of security clearance and access will be grounds for reassignment, demotion, or removal from the Federal Service. Employee must successfully pass a urinalysis screening for illegal drug use prior to appointment and subsequent periodic drug screening thereafter.
Occasional travel is required, which may involve the use of commercial and/or government aircraft.
This position is MISSION ESSENTIAL. Most, if not all, essential job functions must be performed in a Sensitive Compartmented Information Facility (SCIF). The incumbent is required to report for duty, in person, as necessary, in an emergency (regardless of holidays, weekends, nights, furloughs) or conditions such as weather in which non-essential personnel are not expected to report.
