Duties

Help

  • Manages DLA legal organization. Acts for or assists the DLA General Counsel in establishing DLA General Counsel goals and objectives. Provides professional direction and control over subordinate DLA HQ Associate General Counsel and DLA Chief Counsel. Participates in the hiring, placement, promotion, training, and assignment of all DLA attorneys. Provides policy guidance on attorney personnel matters and participates in resource and budget planning for the DLA legal organization. Ensures that personnel management within the DLA legal organization is accomplished without regard to race, color, religion, sex, age, handicap, or national origin. Is responsible for keeping abreast of developments, policy issuances, and other similar material in the equal opportunity field, and for fully supporting the DLA Equal Opportunity Program.
  • Manages DLA Litigation Program. Oversees the management and operation of the DLA Litigation Program. Establishes policies and procedures for the effective operation of the program. In co-ordination with the DLA General Counsel, oversees the general strategy and planning by the DLA Chief Trial Attorney, who is responsible for DLA litigation and all major contract disputes resolution efforts. Ensures that all cases involving DLA before the Armed Services Board of Contract Appeals and the Court of Federal Claims receive high level attention and that the Agency's interests are adequately protected. Ensures that litigation positions and strategies are consistent with DoW and DLA policies. Determines DLA's position on proposed settlements of all pending litigation and approves the initiation of litigation. Through the Chief Trial Attorney, provides regular reports to the Director, DLA, the Senior Procurement Executive, and the DLA General Counsel on the status of litigation and related settlement efforts. Most of DLA's litigation cases are precedent-setting and directly impact DLA and DoW regulations and policies. Through the Chief Trial Attorney, oversees all employee litigation before the Merit Systems Protection Board or the Equal Employment Opportunity Commission. Ensures that litigation positions and strategies are consistent with DoW and DLA policies, are coordinated with senior DLA officials responsible for the management of the employee or employees involved, and that the agency's interests are adequately protected.
  • Alternative Disputes Resolution. Develops and coordinates DLA legal positions for all significant contract disputes with major defense contractors and manages the Agency's Alternative Disputes Resolution (ADR) program. Contract disputes cases frequently involve precedent-setting legal issues, hundreds of millions of dollars, and generate high level DoW and industry attention. Ensures that whenever possible, actual and potential contract disputes with major defense contractors are resolved without costly litigation. Ensures that contract disputes with majo1· defense contractors have a minimal impact on DLA programs and operations and that consistent DLA legal positions are taken in these disputes. Engages in creative and effective interest-based negotiation and alternative dispute resolution. Ensures that mediation, a form of Alternative Disputes Resolution, is offered to employees in personnel or EEO complaints so that disputes- may be resolved quickly and in the best interests of all parties.
  • As directed by the DLA GC, manages DLA Suspension and Debarment Program and Fraud Program. May be directed to oversee the management and operation of the DLA Suspension and Debarment Program and Fraud Program. Oversees thCounterfeit Materials/Unauthorized Product Substitution (CM/UPS) teams, multidisciplinary teams at each PLFA that detect fraudulent parts and suppliers. Establishes policies and procedures for the effective operation of the program. Responsible for ensuring the detection, reporting, investigation and prosecution of fraud cases involving DLA operations or functions. Ensures that effective administrative and remedial actions are pursued in all cases. Establishes CM/UPS policies that provide for the prompt review and referral of contractor suspension and debarment cases for consideration by the DLA debarring official. These referrals can result in a final decision pursuant to the Federal Acquisition Regulation (FAR) to debar or suspend companies and individuals from contracting with the Federal Government.
  • Liaison with major defense contractors, law firms, and the Department of Justice. Works with senior executives of large defense corporations, including company presidents, vice presidents, and general counsel. Routinely has contact and liaison with major law firms representing large defense contractors in disputes with DLA that involve significant contract issues and large dollar amounts. Maintains direct, continuing liaison with senior officials of the Department of Justice and other federal agencies.

TECHNICAL QUALIFICATIONS (TQs):

  1. TQ 1: Demonstrates the ability to lead and manage a worldwide, geographically dispersed legal organization, effectively serve as a member of executive leadership, and work with a diverse senior client base to ensure continued mission success.
  2. TQ 2: Demonstrates comprehensive knowledge of diverse legal areas: acquisition law; ethics; personnel., EEO and labor law; fiscal law; business integrity and procurement fraud; international and operational law; military law; administrative law; disputes resolution; litigation; environmental law and FOIA and Privacy Act matters, coupled with a demonstrated ability to effectively communicate complex legal issues and options to senior leadership and staff, both orally and in writing.

EXECUTIVE CORE QUALIFICATIONS (ECQs): In addition to the Technical Qualification Requirements listed above, all new entrants into the Senior Executive Service (SES) under a career appointment will be assessed for executive competency against the following five mandatory ECQs. If your 2-page resume does not reflect demonstrated evidence of the ECQs and TQs, you may not receive further consideration for the position. There are five ECQs:
  • ECQ 1: Commitment to the Rule of Law and the Principles of the American Founding - This core qualification requires a demonstrated knowledge of the American system of government, commitment to uphold the Constitution and the rule of law, and commitment to serve the American people.
  • ECQ 2: Driving Efficiency - This core qualification involves the demonstrated ability to strategically and efficiently manage resources, budget effectively, cut wasteful spending, and pursue efficiency through process and technological upgrades.
  • ECQ 3: Merit and Competence - This core qualification involves the demonstrated knowledge, ability and technical competence to effectively and reliably produce work that is of exceptional quality.
  • ECQ 4: Leading People - This core qualification involves the demonstrated ability to lead and inspire a group toward meeting the organization's vision, mission, and goals, and to drive a high-performance, high-accountability culture. This includes, when necessary, the ability to lead people through change and to hold individuals accountable.
  • ECQ 5: Achieving Results - This core qualification involves the demonstrated ability to achieve both individual and organizational results, and to align results to stated goals from superiors.
Note: If you are a member of the SES or have been certified through successful participation in an OPM approved SES Candidate Development Program (SESCDP), or have SES reinstatement eligibility, you must attach proof (e.g., SF-50, Certification by OPM's SES Qualifications Review Board (QRB) of your eligibility for noncompetitive appointment to the SES. Education

1) Professional law degree (LLB. or J.D.)

2) Proof that you are licensed and a member in good standing with the bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. Annual bar certification cards issued from your state of licensure are not considered acceptable. Proof is a "certificate of good standing" issued by your state of licensure dated within 6 months of the closing date of this announcement or a screenshot of your bar status taken from your state of licensure website that is dated within 6 months of the closing date of this announcement or sworn statement to that effect. If there is not a date on the screen shot, you must provide a statement signed by you on the date that the screen shot was created. The successful applicant selected for employment must provide a "certificate of good standing" issued by their respective bar showing they are in good status and in active status prior to appointment.

DoW Joint Enterprise-Wide Experience Statement: In addition, DoW requires an Enterprise Perspective. This individual must have the ability to apply a broad point of view and an awareness and understanding of individual or organizational responsibilities in relation to DoD or government-wide strategic priorities is required. Executives must demonstrate ability to work with internal and external partners to support national security objectives. This perspective is typically gained through a variety of diverse work experiences. This information should be embedded within the resume.

Mobility: Organizational and geographical mobility is essential in developing and managing SES leaders. Individuals selected for SES positions members may be subject to reassignment across geographical, organizational, and functional lines, and may be required to sign a Reassignment Rights and Obligation Agreement.

Tiering: The Department/Agency structures its SES positions into categories (i.e. tiers) to determine the pay range for each position. The categories are based on the position scope, breadth, functions, and placement within the structure of organizational levels across the Department/Agency.

OPM must authorize any employment offers made to current or former (within the last 5 years) political Schedule A, Schedule C, or Non-career SES employees in the executive branch. If you are currently, or have been within the last 5 years, a political Schedule A, Schedule C, or Noncareer SES employee in the executive branch, you must disclose that to the Human Resources Office.

Veteran's preference does not apply to the SES.

DRUG-FREE WORKPLACE: The Defense Logistics Agency (DLA) has established a Drug-Free Federal Workplace Policy. All applicants tentatively selected for DLA employment in a testing designated position are subject to urinalysis to screen for illegal drug use prior to appointment. Applicants who refuse to be tested will be denied employment with DLA for a period of six months. This policy extends to random testing for the use of illegal drugs by employees who occupy testing designated positions defined as sensitive in Section 7(d) of Executive Order 12564. The Defense Logistics Agency's Drug Free Workplace Plan's drug testing panel includes testing for the following illegal substances: marijuana, cocaine, opiates (codeine/morphine), 6-Acetylmorphine (heroin), phencyclidine, amphetamines (amphetamine/methamphetamine), methylenedioxymethamphetamine (MDMA), methylenedioxyamphetamine (MDA), oxycodone, oxymorphone, hydrocodone, and hydromorphone.

You will be evaluated for this job based on how well you meet the qualifications above.

The selectee will be required to timely and successfully complete an ECQ based structured interview with the OPM QRB and obtain QRB certification, unless the selectee provides evidence of their noncompetitive status (i.e., a current SES, OPM QRB certified SESCDP graduate, or SES reinstatement eligible).
