The Law Clerk (Labor) (Litigation Law Clerk) position is in the Contempt, Compliance and Special Litigation Branch of the Division of Legal Counsel. This Branch conducts civil contempt litigation in the U.S. Courts of Appeals to coerce compliance with judgments enforcing orders of the Board and assists the Regions in their compliance work. The Branch also defends the Agency when programs, statutes, or outside proceedings threaten the Agency's ability to carry out its mission.

Help

As a Law Clerk (Labor) (Litigation Law Clerk), GS-0904-11, typical work assignments in the General Counsel Headquarters may include:

  • Assisting in representing the Agency in litigation before federal appellate, district, and bankruptcy courts.
  • Under supervision, investigating and recommending whether contempt proceedings are warranted for securing compliance with judgments enforcing Board orders and initiates contempt actions.
  • Assisting with the development of legal strategies to secure remedies for unfair labor practice cases through active litigation or providing legal advice to Agency stakeholders.
  • Assisting with the defense of the Agency against litigation that seeks to enjoin Board proceedings by analyzing the potential impact, and by developing and implementing appropriate legal strategies.
  • Under supervision, preparing legal documents necessary for federal court litigation including all pleadings, petitions, motions, briefs, affidavits, proposed orders, replies, responses, etc.
  • Performing other duties as assigned.

IDEAL CANDIDATE STATEMENT
The Ideal Candidate for the Law Clerk (Labor) (Litigation Law Clerk) position is a law school graduate - who is not yet barred - with interest regarding the National Labor Relations Act, as well as other statutes such as the Administrative Procedure Act and the U.S. Bankruptcy Code. In addition, the Ideal Candidate displays the ability to conduct strong legal research, review and analyze evidence, draft clear legal documents, and assist attorneys in litigation and compliance. Excellent writing, communication, and interpersonal skills are preferred.

BASIC REQUIREMENTS
Education: To be considered for this position, applicants must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD) by closing date of the vacancy announcement.

Bar Certification: To be considered for this position, applicants must not be barred/licensed on the closing date of this vacancy announcement but must be able to obtain their Bar/License Certification within 14-months of their appointment. Once obtained, applicants will be converted into a permanent position.

MINIMUM QUALIFICATIONS
In addition to the education and bar requirements, applicants must also successfully meet the knowledge, skills, and/or abilities listed below:

  • Knowledge, skills, or ability to analyze factual and legal issues to make recommendations on the strength of a case; and
  • Knowledge, skills, or ability to conduct legal research to uncover relevant precedent; and
  • Knowledge, skills, or ability to produce written work products that effectively communicate facts and issues relevant to case matters.

Optional Four Essay Questions
At the time of application, applicants will be provided with four short, free-response essay questions designed to ascertain their dedication to public service for the hiring manager and agency leadership (or designee) to review. For evaluating the quality of applicants for referral to the selecting official, a four-phased process will be used.

Phase 1: Applicants resumes and supporting documents are reviewed by Human Resources (HR) to ensure they meet the basic qualification requirements. If applicants meet basic qualifications, they will continue on to the second phase.

Phase 2: Applicants who are minimally qualified will be advanced to a Structured Resume Review assessment conducted by a Subject Matter Expert (SME) panel. SME will review your resume to determine your technical qualifications for this position based on the required specialized experience.

Phase 3: Applicants passing the Structured Resume Review assessment will be advanced to a Structured Writing Sample Review conducted by a Subject Matter Expert (SME) panel. Phase 4: A final score which combines the scores from all assessments will be determined. The scores will be used to identify the top-rated applicants. The top-rated applicants will be referred to the selecting official for consideration and may be required to participate in one or more interviews as part of the hiring process.

THE RULE OF MANY
The NLRB uses the Rule of Many which ranks job applicants numerically and allows for selection from a broader, top-ranked pool. Applications will be evaluated and rated using the Rule of Many procedures under 5 C.F.R. §332.402 based on a set number, score or percentage of highest ranked eligibles. Preference eligibles will receive 5 or 10 points added to their score based on the adjudicated preference. All eligibles at or above the pre-determined number, score or percentage, including any preference eligibles with a service-connected disability of 10 percent or more, at any score, will be referred to the selecting official for consideration.
