Duties

Help

Leads and independently manages research, formulation, and drafting of federal rulemakings in collaboration with OPM's Office of Workforce Policy & Innovation (WPI) and Office of General Counsel (OGC).

Independently reviews proposed and final rules for legal sufficiency and consistency with governing statutes, Executive Orders, and court decisions; advise senior agency officials on necessary revisions.

Leads coordination with the Office of Management and Budget (OMB) and the Office of Information and Regulatory Affairs (OIRA) in the regulatory review process, serving as principal point of contact on significant rulemakings.

Directs the development of policies, precedent-setting decisions, and directives; exercise independent judgment in identifying emerging legal and policy issues requiring regulatory attention.

Leads legal research on highly complex questions involving Federal personnel law, labor-management relations law, administrative law, and related statutory and regulatory frameworks, often in areas where legal guidance is limited or evolving.

Prepares authoritative legal memoranda, analytical papers, and executive-level briefing materials for the General Counsel, Deputy General Counsel, and agency leadership.

Serves as the primary liaison between FMCS and representatives of other agencies such as the Department of Justice and the National Labor Relations Board with respect to matters of common concern; independently negotiates and coordinates on matters affecting FMCS programs.

Provides legal advice to the Director and senior agency officials on the most sensitive and complex employment law, ethics, and administrative law matters affecting the agency.

  • You must be an active member in good standing of the bar of a U.S. state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.

Qualifications

Basic Requirement: You must have earned a professional law degree (J.D. or LL.B.) from a law school accredited by the American Bar Association, be an active member of the BAR, and have three years of professional legal experience with at least one year being equivalent to the GS-13 level.

Specialized Experience: Specialized experience is experience that has equipped the applicant with the particular competencies/qualifications to successfully perform the duties of the position and is typically in or related to the work of the position to be filled.


Specialized experience equivalent to at least the GS-13 level includes:
  • Analyzing complex facts, ascertaining relevant laws, regulations, and policies, giving opinions and stating facts on legal issues;
  • Applying and interpreting legal principles and identifying alternative courses of action;
  • Conveying legal analysis and information orally through briefings, meetings, and presentations.
  • Regulatory/Policy: Ability to analyze and draft notices of proposed rulemaking, and final rules. (Knowledge of government personnel rules is a bonus); and
  • Legal: Experience as Labor & Employment attorneys and strong writing ability.
Time in grade: Current federal employees applying for a promotion opportunity must meet time-in-grade (TIG) requirement of 52 weeks of service at the next lower grade level in the normal line of progression for the position being filled.

You must also have experience demonstrating each of the five competencies listed below.

Administrative Law - Knowledge of state and federal administrative laws, including procedures, regulations, guidelines, and precedents related to case preparation and settlements.

Labor Law - Knowledge of state and federal employment laws, regulations, guidelines, and legal precedents related to hiring practices, equal employment opportunity, and wage and hour restrictions.

Legal, Government, and Jurisprudence - Knowledge of laws, legal codes, court procedures, precedents, legal practices and documents, Government regulations, Executive orders, agency rules, Government organization and functions, and the democratic political process.

Manages and Organizes Information - Identifies a need; gathers, organizes, and maintains information; determines its importance and accuracy, and communicates it by a variety of methods.

Planning and Evaluating - Organizes work, sets priorities, and determines resource requirements; determines short- or long-term goals and strategies to achieve them; coordinates with other organizations or parts of the organization to accomplish goals; monitors progress and evaluates outcomes.

Education

Must be a graduate of a law school accredited by the American Bar Association with a Juris Doctor (J.D.) or LLM degree, and be currently licensed as an attorney, in active (or equivalent) status and in good standing, with the bar of a U.S. state, territory, or commonwealth.

Salary- The salary range indicated in this announcement reflects the minimum locality pay up to maximum locality pay for Washington, DC.
