THIS IS A NATIONAL GUARD TITLE 32 EXCEPTED SERVICE POSITION.

This National Guard position is for a ATTORNEY-ADVISER (GENERAL), Position Description Number D1240000 and is part of the CO JFHQ, National Guard.

The primary purpose of the position is to serve as the full-time professional legal adviser and support to the Adjutant General, the Commander of federally recognized Army and Air National Guards, subordinate commands, and state/territory unique public defense or safety structures.

Duties

Help

Acts as a legal adviser and attorney for the state/territory National Guard, responsible for the formulation of state/territory legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law; international law and treaty agreements; trial defense; and a full spectrum of expert legal advice. Responsible to advise on the legal, factual and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted and emotionally charged issues such as intelligence oversight related to Homeland Security, or advising on Federal and state/territory Executive Orders for the use of federalized troops in response to domestic emergencies and natural disasters. Serves as a state/territory National Guard litigation point of contact. Serves as an attorney/adviser providing acquisition and fiscal legal advice to the state/territory's assigned United States Property & Fiscal Officer (the Chief of the National Guard Bureau's agent in the state/territory) and active-duty military advisers. Acts as the Adjutant General's representative in third-party proceedings under Federal labor-management and equal employment opportunity statutes and regulatory provisions. Advises the convening authorities, including the state/territory Adjutant General, on procedural and legal issues associated with Courts Martial, Non-Judicial Punishment Administrative Board proceedings and subsequent actions. Serves as a state/territory Ethics Adviser. Serves as a claims officer for the state/territory National Guard. Provides guidance to the state/territory Judge Advocate's Legal Office, Legal Assistance and Preventative Law Programs, and supervises assigned full-time support staff. Performs other duties as required.

  • Must obtain and maintain a Secret clearance.
  • Incumbent must be an active member of the bar in good standing in Colorado.
  • Participation in direct deposit is mandatory.
  • Membership in the Colorado Army National Guard.
  • Must hold the grade of O-2 thru O-4.
  • Compatible Military Assignment: 27A MOS.
  • Submit all required documentation.
  • Must possess a valid state driver’s license to operate government motor vehicles, for the state in which they live or are principally employed, in accordance with Army and Air Force Vehicle Operations Directives.
  • As an Officer in the Army National Guard JAG Corps, must have completed the 14-week Judge Advocate General Basic Course.
  • No record of conviction by civilian courts of offenses listed in the applicable Service Military Justice regulations.
  • Must not have any military disciplinary action on military records for engaging in an unprofessional or inappropriate relationship as defined in applicable DoD Instructions concerning Army and Air Force Professional and Unprofessional Relationships.
  • Must not have any Unfavorable Information Files, civil convictions (other than minor traffic violations), or open Inspector General investigations.
  • May convert to Permanent without further competition.
  • If converted to Permanent you may be required to successfully complete a probationary period.

Must have experience in each of the following:
1. 24 months' work experience as a professional Attorney.
2. Experience collecting and analyzing data effectively, efficiently, and accurately.
3. Experience or knowledge of military and civilian laws, directives, regulations, policies, and procedures.
4. Ability to clearly enunciate English without impediment of speech that would interfere or prohibit effective communications & write English in reports and presentation formats.
5. Experience in interpersonal communications, empathy, and effective listening.
6. Experience in communicating -orally and in writing- clearly and effectively.
7. Experience organizing thoughts, research materials, and manage case projects; and skilled in comprehending and interpreting directives and laws.
8. Knowledgeable of the Army National Guard and Air National Guard mission requirements.
9. Competent in providing legal interpretation and guidance to managers and senior leaders on United States Code Title 32 ยง 709, National Guard Program.
10. Able to recognize and identify complex constitutional, state-federal, and military-civilian jurisdictional issues frequently associated with the organization and administration of the Title 32 National Guard, and articulate them in the appropriate forum or context.
11. Competent in providing legal interpretation and guidance to managers and senior leaders on 10 United States Code, and the state equivalent to the federal Uniform Code of Military Justice.
12. Experienced in researching and providing legal advice in all functional areas of Administrative, Labor, Medical and Physical Disability, and Ethics Law.
13. Experienced in developing and providing solutions to conflicting or contradictory DoD regulations, directives, and policies, and other NGB or state legal guidance.
14. Experienced in preparing memoranda of reports that outlined and analyzed the factual and legal issues and have experiences involved preparing legal documents or advisory opinions, participated in contract negations, and examined documents for legal sufficiency.

Education

You must meet the following Education requirement to qualify for this position: Bachelor of Laws or Juris Doctor degree in law issued by an ABA- accredited law school; and must be admitted to practice law in Colorado.

Per ARNG-HRH Policy Memorandum #10-39, mandatory Full Time Staff (FTS) training is required within a year of hire as a condition of employment in vacancy announcements for both Technician and Active Guard Reserve positions. Failure of new FTS personnel to complete NGB prescribed courses at PEC within the first year of employment may be cause for reassignment to other full time positions or termination of their employment.
