Are you an exceptional legal and organizational leader ready to guide one of the most influential tribunals in intellectual property law? The Chief Patent Judge plays a pivotal executive role in shaping the future of patent adjudication and policy at the United States Patent and Trademark Office. Serving under the administrative direction of the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office, the Chief Judge provides visionary leadership and strategic oversight for the Patent Trial and Appeal Board.

As the Chief Administrative Patent Judge for the Patent Trial and Appeal Board (PTAB), you will:

  • Serve as a full voting member of the PTAB exercising full administrative, legal and technical authority over the Board.
  • Develop rules and regulations governing Board procedure, and periodically update the same as circumstances warrant.
  • Ensure predictability, reliability, and consistency across the thousands of decisions issued every year by the several hundred Board judges that he or she will oversee.
  • Adjudicate petitions for the Under Secretary of Commerce for Intellectual Property and Director of the USPTO.
  • Perform the comprehensive executive management, strategic planning, and financial functions essential to effective Board operation.
  • Be responsible for the assignment of panels of administrative patent judges to adjudicate all patent appeals, interference and derivation. proceedings, and AIA trial proceedings, on which panels the Chief Judge periodically serves.
  • Develop and implement quality, timeliness, and productivity performance standards for the Judges.
  • Interact with the legal community, including the Court of Appeals for the Federal Circuit, bar associations, participate in public conferences and meetings, and make presentations to foreign dignitaries regarding the Board.

Qualifications

To meet the minimum qualification requirements for this position, you must show that you possess the five Executive Core Qualifications (ECQs) and Technical Qualifications (TQs), listed below. TECHNICAL QUALIFICATIONS (TQs): Your resume should demonstrate accomplishments that would satisfy the technical qualifications.

TQ 1: Expert knowledge of the legal principles and technical subject matter associated with patent appeals, interferences, post grant reviews, inter partes reviews, derivations, and CBM proceedings. Demonstrated ability to understand technical subject matter, apply relevant patent law legal principles involved in patent appeals, interferences, post grant reviews, inter partes reviews, derivations, and CBM, and effectively work in groups to resolve complex technical and legal issues.

TQ 2: Demonstrated executive level experience in directing, supervising, and evaluating the activities of a professional, technical, and legal organizational unit. Demonstrated ability to develop and achieve organizational goals, prepare and execute organizational budgets, delegate assignments, motivate subordinate groups and individuals, establish and execute programs to implement policies, and establish and maintain a positive working environment.

EXECUTIVE CORE QUALIFICATIONS (ECQS): In addition to the Technical Qualification requirements listed above, all new entrants into the Senior Executive Service (SES) under a career appointment will be assessed for executive competency against the following five mandatory ECQs. ECQ 1: Commitment to the Rule of Law and Principles of the American Founding: Requires a demonstrated knowledge of the American system of government, commitment to uphold the Constitution and the rule of law, and commitment to serve the American people.

ECQ 2: Driving Efficiency: Involves the demonstrated ability to strategically and efficiently manage resources, budget effectively, cut wasteful spending, and pursue efficiency through process and technological upgrades.

ECQ 3: Merit and Competence: Involves the demonstrated knowledge, ability and technical competence to effectively and reliably produce work that is of exceptional quality.

ECQ 4: Leading People: Involves the demonstrated ability to lead and inspire a group toward meeting the organization's vision, mission, and goals, and to drive a high-performance, high-accountability culture. This includes, when necessary, the ability to lead people through change and to hold individuals accountable.

ECQ 5: Achieving Results: Involves the demonstrated ability to achieve both individual and organizational results, and to align results to stated goals from superiors.

Note: If you are a member of the SES or have been certified through successful participation in an OPM approved SES Candidate Development Program (SESCDP), or have SES reinstatement eligibility, you do not need to respond to the ECQs. Instead, you should attach proof (e.g., SF-50, Certification by OPM's SES Qualifications Review Board (QRB)) or your eligibility for noncompetitive appointment to the SES.

Education

Due to the complexity of this position, the Chief Judge must possess both a technical degree and a law degree. Additionally, the Chief Judge must be a member in good standing of the Bar of any state, the District of Columbia, Puerto Rico, or any territorial court under the Constitution. Furthermore, the Chief Judge must possess significant work experience in both the fields of patent law and organizational management.

Organizational and geographical mobility is essential in developing and managing SES leaders and generally is a key to advancement. Therefore, applicants are expected to be mobile and once appointed SES members, may be reassigned at the discretion of the appointing authority.
