Duties

Help

You will serve as Senior Attorney primarily responsible for litigation with respect to civilian personnel; civil rights; and labor and employment law. Specific areas of expertise are civilian personnel law; merit systems; Equal Employment Opportunity law; labor law; civil rights; and litigation before the Equal Employment Opportunity Commission (EEOC), the Merit Systems Protection Board (MSPB), the Office of Special Counsel, and the Federal Labor Relations Authority. You may occasionally take on legal counseling duties or serve on interagency teams in the same substantive areas.

Being a Coast Guard (CG) civilian makes you a valuable member of the CG team. Typical work assignments include:

  • Provide high quality legal representation in all civilian employment litigation across the Coast Guard. Acts as trial attorney before examiners and Administrative Law Judges representing the Government, DHS, and USCG activities before the Office of Personnel Management, MSPB, EEOC on mediations, employee grievances, appeals, adverse actions, and EEO complaints and the Federal Labor Relations Authority (FLRA) on issues concerning unit representation petitions and unfair labor practices (ULP) under Title VII, Civil Service Reform Act (CSRA), as amended.
  • Oversee and assist in the preparation and presentation of all cases to ensure that issues involving major policy questions are adequately presented before these tribunals.
  • Act as the reviewing authority for grievances and appeals made by civilian employees to the Secretary of DHS, OPM, and MSPB and prepares USCG's position when cases are appealed to the EEOC, the MSPB, and the FLRA
  • Provide professional legal advice and related services to a range of individuals in the agency; provide authoritative advice and assistance on the effects of laws, executive orders, and DHS policies on existing and proposed CG civilian personnel and civil rights practices.
  • Prepare written opinions and responses to proposed legislation, regulations, executive orders, and policies affecting the civilian personnel and civil rights programs. Prepares complex proposals, responses to policy inquiries, letters, legal memoranda, and testimony.
  • Advocate on behalf of agency before courts, boards, commissions and other fora charged with the adjudication of civilian personnel; civil rights; and labor and employment law; conduct opening statements and closing arguments; direct examination; cross examination; and makes on the spot objections supported by law and Federal/Court Rules.

Qualifications

Qualifications:

All Candidates must possess a J.D. or LL.B degree from an accredited law school;

AND

Must be a member in good standing of the appropriate licensing authority of any state, territory of the United States, Commonwealth of Puerto Rico or District of Columbia bar.

AND

To qualify for the GS-14 level position, must: have successfully completed at least one full year of professional legal experience as a practicing attorney equivalent to the GS-13 level in the Federal service, as reflected in the nature and complexity of case work and legal issues for which responsible, the level of responsibility exercised, and the degree to which such experience equipped the applicant with the particular knowledge, skills, and abilities required to successfully perform the duties of this position.

National Service Experience (i.e., volunteer experience): Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience

Education Requirements:
This position has a positive education requirement.
