Duties

Help
  • Serves as the installation Environmental Law Attorney-Advisor.
  • Research, analyze, and interpret new environmental legislation which may conflict with existing Army regulations.
  • Review, research, and provide legal interpretation of a wide range of federal environmental statues.
  • Advise and inform the Fort Bragg Command Group and Environmental/Natural Resources Division, DPW of existing, newly enacted, and potential environmental legislation, regulations, and legal issues impacting on the installation's mission.
  • Represent Fort Bragg on matters involving environmental law issues which cannot be resolved at lower command levels.
  • Serves as the primary Environmental Law and Real Property Attorney for Fort Bragg and associated facilities including Simmons Army Airfield, Camp Mackall, and Smith Lake which are geographically located in Central North Carolina.
  • Ensures legal compliance with Federal, state and local environmental and real property laws, rules and regulations
  • Routinely coordinates with the installation’s Environmental Director, principal staff agencies, Command, the Environmental Protection Agency (EPA) and state and local officials and agencies to obtain information.
  • Advises, assist in the drafting, negotiating and implementing required environmental permits through coordination with installation stakeholders and Federal and state regulators and attorneys.
  • Defends and handles all environmental litigation arising from military operations on both Fort Bragg and associated facilities.
  • Reviews and responds to legal and policy questions relating to proposed actions by Fort Bragg and associated facilities officials concerning compliance with the National Environmental Policy Act.
  • Interprets laws, rules, and regulations and develops legal unpinning on projects designed to sustain the military operations and training on both Fort Bragg and associated facilities.
  • Serves as the primary Business Law Attorney for both Fort Bragg and associated facilities on matters regarding privatization, outsourcing, OMB Circular A-76, cost studies, appropriations law, fiscal law, inter-agency support, etc.
  • Serves as an Administrative Law Attorney as needed. Advises on questions involving headquarters' operations to include relationships with private associations and the general public.
  • Reviews and provides legal opinions on a variety administrative and civil law actions, and AR 15-6 investigations primarily related to allegations of civilian misconduct.
  • Serves as the alternate Labor Counselor as needed or in the absence of the incumbent. Serves as the Chief of Civil Law Branch, in the absence of the incumbent.

Applicants will be evaluated to determine if they meet the minimum qualification requirements and on the extent to which their application shows possession of the following knowledge, skills and abilities (KSAs) associated with the position. KSA's:

  • Skill in identifying and researching highly technical and complex legal issues.
  • Skill in providing legal, technical, and policy guidance.
  • Ability to effectively, professionally, and ethically manage a heavy caseload of clients with complex legal needs.
Qualification Requirements: The following minimum qualification requirements must be met before applicants are eligible for further consideration:

Education Requirements: Position requires the possession of the first professional law degree (LL.B. or J.D.) AND be in good standing with the bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. Applicants for initial appointment into attorney positions within the Department of Army must be graduates of law schools accredited by the American Bar Association at the time of the applicant's graduation. As indicated below, a law school transcript must be submitted with your application materials.

Bar Membership: Applicants must currently be a member in good standing (as defined by the pertinent bar) of the bar of the highest court of a State, U.S. territory, the District of Columbia, or Commonwealth of Puerto Rico. As noted below, proof of such membership and good standing must be submitted with your application materials.

GS-12: Applicants must possess 2 years of professional legal experience after admission to the bar commensurate with the duties of the position. The Attorney Qualifying Authority may grant an exception to this requirement when an applicant possess special qualifications.

GS-13/GS-14: Applicants must possess more than 3 years of professional legal experience after admission to the bar commensurate with the duties of the position.

Time in Grade: The Qualifying Authorities (QA's) will make a determination as to the applicability of time in grade based on the requirements of the position. If you are currently employed as an attorney by the Federal government, you must have completed one year at the next lower grade level within 30 days of the closing date of the announcement, or previously served at the same or higher grade level as the position being filled.

NOTICE OF VETERAN'S PREFERENCE: There is no formal rating system for applying veteran's preference to attorney appointments in the excepted service; however, the Department of the Defense considers veterans' preference eligibility a positive factor for attorney hiring. Applicants eligible for veterans' preference must include that information in their cover letter or resume and attach supporting documentation (e.g., DD Form 214, "Certificate of Release or Discharge from Active Duty") to their submissions.

Although the point-preference system is not used, applicants eligible to claim a 10-point preference must submit a Standard Form (SF) 15, "Application for 10-Point Veteran Preference", and supporting documentation required for the specific type of preference claimed. The SF 15 will identify the supporting documentation required along with the list of the types of 10-point preference.
