ABOUT THE POSITION

The incumbent serves as the Deputy Director Equal Employment Opportunity, Diversity and Inclusion (EEODI). The Deputy Director of EEODI is responsible for the design, direction, and execution of programs, policies, and procedures based on rules, regulations, laws, and Executive Orders governing equal employment opportunity (EEO), affirmative action, and diversity, equity, inclusion, and accessibility (DEIA) programs.

The incumbent serves as a leading technical expert in policy development for EEO, accessibility, reasonable accommodation, and affirmative action. Provides executive leadership over Department policy development for the EEODI portfolio areas. Applies appropriate legal authorities to frame the policy development and lend legal insights and expertise to the policy framework. Researches and examines trends in case precedent established by the U.S. Equal Employment Opportunity Commission, Merit Systems Protections Board, Comptroller General, Federal Courts of Appeal, U.S. Supreme Court, Executive Orders, Guidance from federal authorities, etc. to determine implications for EEODI policies for development or modification thereto.

Provides executive leadership and support for the direction of the Department's implementation and compliance with the Equal Employment Opportunity Commission's regulations and requirements for an Equal Employment Opportunity (EEO) program. The incumbent provides direction and oversight ensuring the Department's compliance with EEOC regulations and other anti-discrimination laws.

Provides executive leadership for the Department's EEO program including, oversight, policy, development, and implementation of EEO complaint processing, mediations, investigations, final agency decisions, final actions, settlements, and reasonable accommodation. Provide technical assistance to the Department's senior leaders and OPDIV EEO offices on the full spectrum of the EEO program. Ensures all EEO documents are in accordance with applicable EEO laws and EEOC regulations and requirements. The incumbent is responsible for EEO related agency trainings, EEO-related special projects, providing quarterly EEO reports, with trend analysis, to the ASA, modeling and having an active role in developing a positive work environment that is safe from discrimination, sexual harassment and which respects and values diversity in the workplace, etc.

Oversees Departmental audit program of OPDIV EEO programs to ensure compliance and satisfaction of applicable regulatory requirements. Identifies any EEO program deficiencies and develops, recommended corrective action plan to
create/maintain a work environment free from discrimination and harassment. Serves as a primary point of contact with the EEOC, including for EEOC Technical Visits and oversees and monitors any required action to correct deficiencies noted in the Technical Visit. Implements policies and procedures to ensure internal and external compliance with laws, statutes, regulations, and Executive Orders related to EEO program; Monitors effectiveness of policies and procedures to ensure no disparate impact of facially neutral policy or procedure.

Qualifications

As a basic requirement, applicants must demonstrate progressively responsible leadership experience that is indicative of senior executive level managerial capability and directly related to the skills and abilities outlined under the Mandatory/Technical Qualifications and Executive Core Qualifications listed below. Typically, experience of this nature will have been gained at or above the equivalent of the GS-15 grade level in the Federal service or its equivalent with state and local government, the private sector, or non-governmental organizations. Failure to meet this basic qualification requirement and all executive and technical qualification factors will automatically exclude you from further consideration.

All competitive candidates for SES positions with the Federal Government must demonstrate leadership experience indicative of senior executive level management capability. To meet the minimum qualification requirements for this position, you must show in your resume that you possess the Fundamental Competencies, five Executive Core Qualifications (ECQs), and the Mandatory Technical Qualifications (MTQ's), listed below. It is recommended that your resume emphasize levels of responsibility, scope and complexity of programs managed, and program accomplishments and results.

Executive Core Qualifications (ECQs):

5. Building Coalitions: The ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals.

Mandatory Technical Qualifications (MTQ's):

This position also requires that you possess MTQ's that represent knowledge, skills, and abilities essential for success in this role. The following MTQ's must be evident in your resume.

  1. Expert knowledge of the Equal Employment Opportunity (EEO) complaint process, as set out in 29 CFR 1614, and related laws and guidance, that will enable the incumbent to provide policy advice and guidance to the EEO community as well as managers and supervisors
  2. Demonstrated experience leading an equal opportunity and civil rights office for a large, geographically disbursed, agency, bureau, or multi-level organization.

IF SELECTED, you will be required to complete an ECQ package by drafting narratives for each of the ECQs and be certified by an OPM Qualifications Review Board (QRB) in order to be placed in this position. If you are currently serving in a career SES appointment, are eligible for reinstatement into the SES, or have successfully completed an SES Candidate Development Program approved by the Office of Personnel Management (OPM), you WILL NOT need to draft the ECQs.

Additional information

Salary for Senior Executive Service positions varies depending on qualifications. The annual salary range may be found at the top of this announcement. This position may be eligible for performance bonuses and performance based pay adjustments.

Probationary Period:

An individual's initial SES career appointment becomes final only after the individual successfully completes a one year probationary period.

Standards of Conduct/Financial Disclosure

HHS inspires public confidence by maintaining high ethical principles, and all Federal Government employees are subject to the conflict of interest statutes and regulations, including the Standards of Ethical Conduct, that govern activities with outside organizations and reporting financial holdings. The Ethics in Government Act, PL 95-521 also requires the applicant selected for this position to submit a Public Financial Disclosure Report, OGE-278, prior to assuming the SES position, annually, and upon termination of employment.
