At the full performance level, major duties include:

  • Serves as part of a team that (or at the direction of a supervisor), prepares legal memoranda and other legal documents on complex, sensitive legal issues, including those involving questions of first impression and with strong conflicting precedents, which require extensive research, analysis and ingenuity to resolve.
  • Serves as part of a team that (or at the directions of a supervisor) assists in conducting or overseeing legal negotiations of settlements or other resolutions of contractual disputes, claims or liabilities, and provides legal advice and other related legal assistance, including preparing or assisting with the drafting of documentation regarding the same.
  • Responsible for legal matters relating to assigned issues in one or more of the following areas: resolutions, FRF/FSLIC, claims administration, deposit insurance coverage, treatment of failed bank contacts, termination of receiverships, planning and policy analysis, and any other matters that may come within the responsibility of the section.
  • Serves as part of a team that (or at the direction of a supervisor), provides legal and policy advice concerning routine matters associated with failed bank operations, as well as operations of a bridge institution or an institution in conservatorship.
  • Serves as part of a team that (or at the direction of a supervisor), participates in IDI closings and post- closing activities in order to provide advice on novel and legal issues.

The candidate selected will be offered an appointment not-to-exceed 2 years, which may be extended to a maximum of 4 years based on workload requirements and organizational staffing authorizations.

Qualifications

Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g. Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic, religious spiritual; community; student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. CG-13: Applicant must have one year of specialized experience equivalent to at least the grade 12 level in the Federal Service. Specialized experience is experience drafting memoranda and other legal documents; conducting legal research; formulating recommendations; and orally presenting analysis, conclusions, and recommendations.

Specialized experience must be directly related to the position being filled and is experience gained after issuance of bar membership.

This position has a positive education requirement, transcripts must be provided showing degree conferred. Official transcripts must be provided prior to appointment.

  • Education: All attorney and law clerk trainee positions have a minimum education requirement of a Juris Doctorate (J.D.) or Bachelor of Laws (LL.B.) or Master of Laws (LL.M.) from a school  accredited by the American Bar Association (ABA).
  • Bar Membership: All attorney positions require current active bar membership (valid license to practice law). Admission to the bar of any state, District of Columbia, any United States territory or Commonwealth, or Federal Court is acceptable. Active Bar membership must be verified prior to appointment. Employees must maintain active bar membership while employed as an attorney with the FDIC.

  1. Skill in researching, analyzing and resolving routine legal issues with the appropriate recommendations.

  2. Skill in communicating orally.

  3. Skill in written communication.

  4. Skill in structuring, drafting, negotiating and closing routine corporate transactions, analyzing or interpreting existing routine transaction structures, obligations, liabilities and contract compliance, and resolving informal contract disputes.

  5. Knowledge of one or more areas of federal or state law in activities such as: negotiable instruments; payment systems and processing; credit card operations and other consumer credit transactions; correspondent lending relationships; secured transactions; letters of credit; swaps, repurchase transactions, and other derivatives; or structured finance.

  6. Knowledge of the legal aspects of Insured Depository Institution (IDI) supervisory and receivership matters.

  7. Ability to coordinate activities with outside counsel, State or Federal authorities, and other interested parties.
