Summary

You will supervise Trial Attorneys and provide expert advice and assistance on all aspects of the program. As a senior attorney, handle the most complex litigation related to administrative and judicial enforcement cases for the agency.  Be considered an expert on administrative and federal litigation, the administrative Rules of Practice, the Federal Motor Carrier Safety Regulations and related statutes, and other complex projects. May serve as Assistant Chief Counsel for the division.

As a Supervisory Trial Attorney, you will:

  • Perform all supervisory duties for Trial Attorneys within the assigned region including complaint resolution, time and attendance, employee discipline, developing and issuing job performance standards, evaluating performance, assisting employees to reach an acceptable level of competence; counseling employees on career goals and being alert to training and development opportunities for employees.  The Branch Chief is also responsible for all other administrative functions for the Trial Attorneys within the assigned region such as approval of transit benefits, telework agreements, and modified work schedules.
  • Possess expert level knowledge of all statutes, regulations, policies and operations relating to FMCSA enforcement programs.
  • Possess thorough knowledge of FMCSA internal practices relating to enforcement policy development, rulemaking, and administrative functions.
  • Possess expert level knowledge and experience in Federal court litigation relating to the statutes FMCSA administers, the Federal Motor Carrier Safety Regulations, Hazardous Materials Regulations, Federal Motor Carrier Commercial Regulations, and relevant Department of Transportation regulations.
  • Perform under the broad guidance and direction of the Assistant Chief Counsel, with methods and details of work left to their judgment. Reviews and edits briefs, orders, notices and other written work of other Trial Attorneys within assigned Service Center areas and, occasionally and under general direction of Assistant Chief Counsel, outside those areas.  Gives appropriate feedback on written work to subordinate Trial Attorneys. Appropriately briefs the Chief Counsel, Deputy Chief Counsel, and Assistant Chief Counsel.

The ideal candidate will have experience supervising, applying and interpreting federal laws and regulations relating to commercial motor vehicle safety. Litigation and/or enforcement experience at the State, Federal, or appellate levels with federal administrative hearings experience strongly preferred.

  • TRIAL PERIOD: This is an Excepted Service position. This job will be filled by an alternative hiring process and is not in the competitive service. Applicants selected for an excepted service position may be subject to a two-year trial period.
  • SUPERVISORY PROBATIONARY PERIOD: You must complete a one-year supervisory probationary period (unless already completed).
  • ETHICS/CONFLICT OF INTEREST STATEMENT: All employees are subject to the Standards of Ethical Conduct for Employees of the Executive Branch, set out in Title 5 of the Code of Federal Regulations, section 2635, including restrictions on owning financial interests that may conflict with performance of their duties.   • TELEWORK ELIGIBILITY: This position may be eligible for occasional and/or regularly scheduled telework. The number of telework days approved will be determined by your immediate supervisor or manager following the agency’s telework policy and guidance. If participating in the telework program, you will be required to sign a telework agreement detailing agency telework policy requirements, working conditions, and expectations for the position.
  • REMOTE WORK ELIGIBILITY: This position may be eligible for remote work, which does not require reporting to the agency worksite location on a regular basis. If selected for a remote work location, you will be required to sign a remote work agreement detailing agency remote work policy requirements, working conditions, and expectations for the position. The difference in salary is determined by the locality pay in each location. If the position is offered to you remotely (approved to work from home), your home address becomes your duty station for pay setting purposes. Qualifications

To qualify, your experience should include experience and education equal or equivalent to the following:

GRADE 15 - A law degree, bar membership in good standing and at least 3 years of professional attorney experience.

KNOWLEDGE, SKILLS AND ABILITIES (KSAs): Your qualifications will be evaluated on the basis of your level of knowledge, skills, abilities and/or competencies in the following areas:

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social).  Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment.  You will receive credit for all qualifying experience, including volunteer experience.

Education

MANDATORY EDUCATION REQUIREMENTS:

In order to qualify for this position, candidates must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have a professional law degree, and must currently be a member in good standing of the bar of a State or Territory of the United States or the District of Columbia.
