Major duties include but are not limited to:

  • Serves as a FOIA Officer for the Veterans Health Administration and is responsible for VHA's compliance with the FOIA laws and regulations and implementation of Office of Management and Budget (OMB) and Department of Justice (DOJ) regulations and guidance.
  • Interacts closely with all VA/VHA operations to ensure the program is consistent with the overall VA/VHA mission.
  • Utilizes and maintains a comprehensive knowledge of the FOIA, Privacy Act, Health Insurance Portability and Accountability Act (HIPAA), and VA confidentiality statutes, as well as all VA, VHA and DOJ privacy enforcing regulations; OMB guidance and other areas of administrative information law.
  • Reviews and recommends VHA comments and/or amendments concerning proposed legislation and guidance affecting FOIA and Privacy Act, computer matching and VA confidentiality statutes, as proposed by other agencies, primarily OMB, DOJ and Department of Health and Human Services (HHS).
  • Reviews and recommends VHA comments and/or amendments concerning proposed implementing regulations by the Department's FOIA Office.
  • Reviews and recommends concurrence/changes on correspondence and policy written by other VHA and VA offices. Reviews VHA privacy policy to ensure compliance with FOIA requirements when privacy processes have a FOIA component.
  • Works with the VHA Privacy Office to ensure privacy guidance encompasses FOIA, where appropriate.
  • Plans and/or accomplishes special projects as assigned.
Promotion Potential: The selectee may be promoted to the full performance level without further competition when all regulatory, qualification, and performance requirements are met. Selection at a lower grade level does not guarantee promotion to the full performance level. The position will be hired only at a GS-9 and promotion potential to the next level will not be considered until the incumbent has served a full year in this position at the GS-9 level.

Qualifications

To qualify for this position, applicants must meet all requirements by the closing date of this announcement, 05/17/2024.

Time-In-Grade Requirement: Applicants who are current Federal employees and have held a GS grade any time in the past 52 weeks must also meet time-in-grade requirements by the closing date of this announcement. For a GS-9 position you must have served 52 weeks at the GS-7. The grade may have been in any occupation, but must have been held in the Federal service. An SF-50 that shows your time-in-grade eligibility must be submitted with your application materials. If the most recent SF-50 has an effective date within the past year, it may not clearly demonstrate you possess one-year time-in-grade, as required by the announcement. In this instance, you must provide an additional SF-50 that clearly demonstrates one-year time-in-grade. Note: Time-In-Grade requirements also apply to former Federal employees applying for reinstatement as well as current employees applying for Veterans Employment Opportunities Act of 1998 (VEOA) appointment.

You may qualify based on your experience and/or education as described below:

  • Specialized Experience: You must have one year of specialized experience equivalent to at least the next lower grade GS-07 in the normal line of progression for the occupation in the organization. Examples of specialized experience would typically include, but are not limited to: Experience with assisting with FOIA requests OR experience with responding to release of information or medical record requests. OR,
  • Education: a Master's or equivalent graduate degree (such as an LL.B. or J.D.) or at least two full years of progressively higher-level graduate education leading to such a degree in a related field (Transcript required).OR,
  • Combination: Applicants may also combine education and experience to qualify at this level. You must have an combination of specialized experience, as described in the vacancy announcement, and related graduate level education, beyond the first full year of graduate level study, that when combined, meet the qualification requirements for this position (Transcript required).

Note: A full year of work is considered to be 35-40 hours of work per week. Part-time experience will be credited on the basis of time actually spent in appropriate activities. Physical Requirements: The work is primarily sedentary, although some slight physical effort may be required. Some travel may be required.
