Duties

Help

The general duties of the incumbent include detailed and complex legal research, preparing legal memoranda and advice, and communicating with ACHP staff and relevant stakeholders on matters related to the ACHP's responsibilities under Section 106 of the National Historic Preservation Act, 54 U.S.C. 306108, and its implementing regulation at 36 C.F.R. part 800 (Section 106), regarding permitting undertakings, particularly those covered by the Fixing America's Surface Transportation Act (FAST-41). The duties of the incumbent relate to permitting and include:

At the full performance level GG-13 the major duties of this position include, but are not limited to the following:
1. Conducting legal research and analysis on legal and regulatory questions on interagency coordination, review coordination (e.g., Section 106, NEPA) and permitting issues.
2. Analyzing, monitoring and commenting on proposed legislation and regulatory changes affecting environmental reviews.
3. Coordinating with agency staff on proposed and enacted policy, guidance, and programmatic review changes.
4. Assisting in the development of ACHP regulatory advice and comments
5. Assisting with the compilation, review, and redaction of records that are responsive to Freedom of Information Act requests involving permitting projects
6. Providing legal review of agreements or program alternatives under Section 106, and providing advice on their negotiation and drafting.

Salary:
The actual duty station will be negotiated upon selection. Salary will vary depending on duty station location.

Qualifications

Minimum Qualification Requirements:

To qualify for this vacancy, you must meet both the basic and specialized experience requirements.

Basic Requirement:
To meet the basic qualification requirements for this position, you must:

  1. Meet the minimum education requirements of successful completion of a full course of study in a school of law accredited by the American Bar Association (ABA) with a professional law degree (LL.B. or J.D.);
  2. Be a current, active member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico; and
  3. Have at least one year of professional (attorney) legal experience
Specialized Experience:
You must possess at least one full year of specialized experience equivalent to the GS-12 level in the Federal service, or comparable experience not gained through Federal service. Specialized experience is considered that which is in, or directly related to, the line of work of the position to be filled, and which has equipped the applicant with the particular knowledge, skills, and abilities to successfully perform the duties of the position. This is defined as experience that demonstrates:
  1. Performing legal work that has a focus on Section 106 of the National Historic Preservation Act of 1966 (NHPA).
  2. Conducting research, analysis and assessment of applicable laws or regulations to prepare a legal opinion.
**While knowledge and expertise on the Freedom of Information Act (FOIA) is not required at the time of hiring, the incumbent is expected to quickly become familiarized with FOIA.

A preliminary background check must be completed before a new employee can begin work with the Advisory Council on Historic Preservation (ACHP). The preliminary background check consists of a search of Office of Personnel Management and Department of Defense background investigation files and an FBI National Criminal History Fingerprint Check; it may take up to 3 weeks to complete. If selected for this position, you will be extended a tentative offer of employment pending a satisfactory background check. Current Federal employees or individuals with an existing completed background investigation may not be required to undergo another background check; these will be handled on a case-by-case basis in coordination with the Bureau security office.
