Duties

Help

This position is located in the Departmental Freedom of Information Act (FOIA) Office and will be assigned to the FOIA Litigation Team (FLT). The incumbent will produce discrete tangible work products such as completing document reviews for applicable exemptions prior to their release under the FOIA and to ensure compliance with the statute, help maintain an up-to-date docket for the agency, provide advice and guidance on the FOIA to employees at all levels within DOI, and help identify areas of vulnerability and liability regarding the FOIA program. This is a permanent position.

At the full performance level (GS-14) the major duties of this position include, but are not limited to the following:

1. Assumes and manages a caseload of Freedom of Information (FOIA) litigation in close collaboration with attorneys in the Division of General Law.

2. Assists other attorneys in the subject matter divisions and regions of the Office of the Solicitor in the implementation of coordinated legal strategies and best practices in FOIA cases.

3. Conducts legal research and research of internal agency policies, procedures, and methods.

4. Drafts analytical work products including Vaughn Indexes, declarations, or legal documents/pleadings.

5. Reviews others' written work products to ensure clarity of message, particularly in legal filings.

6. Works with Bureau FOIA Officers on strategy in both litigation and the administrative stages of FOIA.

Starting Salary Range Information
Remote (Location Negotiable After Selection): GS-13: $103,409- $167,336; GS-14: $122,198- $191,900

NOTE: First time hires to the Federal Government are typically hired at the Step 01.

Qualifications

In order to better assess your qualifications for this position, when preparing your resume and cover letter please be sure to address any experience you may have or familiarity with the following areas of legal work: researching and writing legal memoranda and opinions and providing legal advice or recommendations to clients and/or senior attorneys. In addition, please address your experience in or familiarity with the following subject matter areas and legal authorities: ethics law; Federal administrative law issues, such as matters arising under the Administrative Procedure Act, the Freedom of Information Act, the Privacy Act, and appropriations law.

Basic Qualification Requirements
Applicants must be law school graduates with LL.B. or J.D. degrees AND applicants must be an active member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico bar.

Applicants must also meet one of the following: In addition to meeting the basic qualification requirements described above, applicants must also have the following additional years of professional legal experience for the grade level indicated:

    • To qualify for a GS-13 applicants must possess at least 3-years of professional legal experience following law school graduation.
    • To qualify for a GS-14 applicants must possess at least 4.5-years of professional legal experience following law school graduation.

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g. Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student; social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

For any of the grades indicated above you can substitute one year of experience with any of the following:

  1. have a second professional law degree; OR
  2. meet any of the criteria indicated below:
  • academic standing in top one-third of law school graduating class;
  • other equivalent evidence of clearly superior achievement.
  • significant summer law office clerk experience; or
  • significant participation in a clinical legal aid program;
  • significant participation in the law school's moot court competition.
  • significant participation on the law school's law review;
  • graduation with academic honors.

Candidates should have excellent oral communication, writing, research and analysis skills, and the ability to work effectively with other people, and exercise sound judgment.

When preparing your resume and cover letter, please be sure to address your experience, skills, and substantive knowledge in the following areas:
- The Freedom of Information Act (FOIA), accompanying regulations, and policies.
- FOIA litigation experience, including knowledge of governing caselaw and other key authorities that inform effective FOIA litigation practice for federal government agencies.
- Legal Research experience demonstrating your ability to constantly stay up to date on new FOIA decisions and applicable laws.
- Experience planning, organizing, and scheduling projects under tight deadlines considering competing priorities.
- Experience reviewing others' written work to ensure clarity of message.
- Experience writing analytical work products, declarations, or legal documents/pleadings.
- Communication and collaboration experience demonstrating your ability to effectively work with a wide range of stakeholders.
