Duties

Help

Duties include but are not limited to the following:

  • Researches and interprets issues involving removal, admissibility, rescission, asylum, cancellation of removal, adjustment of status, and other legal issues arising under the immigration and nationality laws.
  • Provides technical assistance to the Immigration Judge in preparation for hearings, drafting findings of fact, conclusions-of-law, and orders based upon evidence submitted.
  • Analyzes records of proceedings for adherence to procedural requirements and proper interpretation and application of judiciary statutes, regulations and precedents.
  • Examines formal filings for legal sufficiency and reviews submission from party representatives to ensure procedural requirement are met.
  • Provides input to the development of policies and procedures in response to legal cases or problems and/or provide advice on novel questions and responses to substantive procedural questions concerning violations of immigration law or other areas of immigration law.

Qualifications

In order to qualify for the Attorney Advisor position, you must meet the following minimum qualifications:

  • Education: Applicants must possess an LL.B. or a J.D. degree. (Provide the month and year in which you obtained your degree and the name of the College or University from which it was conferred/awarded.)
AND
  • Licensure: Applicants must be an active member of the bar, duly licensed and authorized to practice law as an attorney under the laws of any state, territory of the U.S., or the District of Columbia. (Provide the month and year in which you obtained your first license and the State from which it was issued.)
AND

Required Experience:
For GS-13: Applicants must have two (2) full years (24 months) of post J.D. or LL.B professional legal experience.

Qualifying professional legal experience includes: Negotiating with individuals or groups representing widely divergent backgrounds, interests, and points of view, including Congress, members of the bar, legal representatives, and immigration officials; Advanced writing skill in order to draft clear and concise legal opinions involving complex legal questions or factual issues pertaining to laws and regulations of the Immigration and Nationality Act and related statutes to individuals or varied groups; and effective oral communication and negotiation skills in order to build effective working relationships with all levels of EOIR personnel, as well as the ability to persuade individuals, attorneys, government officials and others to accept legal decisions, or changes in policy, procedures, laws and regulations.

Preferred Experience:

The ideal candidate will have experience with the following:
  • Experience preparing proposed orders reflecting analysis of issues and recommendations for disposition;
  • Experience conducting research to determine if evidence was adequate to sustain findings of fact; and,
  • Experience evaluating pertinent facts and evidence to interpret and apply statutes and regulations in the analysis of pleadings.
NOTE: Qualifying experience is calculated only after receipt of J.D. or LL.B.
