The Deputy Director is a key member of the Bureau's management team and is delegated to act for the Bureau Director in interpreting and carrying out the Commission's objectives in the broad area of consumer protection. In fulfilling these responsibilities, the Deputy Director shares with the Director responsibility for establishing policy, overseeing program direction, and providing the necessary leadership and strategic planning regarding the Bureau's role in the consumer protection mission. In exercising important policy functions, the incumbent reviews policy recommendations that affect the Consumer Protection Bureau and FTC's mission; considers political, social, economic, technical, and administrative factors that may potentially impact recommended policies; and formally recommends action to the approving official. The Deputy Director participates fully in relevant meetings, making legal and policy decisions on new proposals from the divisions and regional offices concerning consumer protection matters. The Deputy Director, together with division and regional managers, serves as a primary link between the Bureau and the Commission, with the Deputy Director having full signatory authority for all consumer protection matters forwarded.

The Deputy Director acts for the Director in resolving both administrative and substantive matters, shares responsibility with the Director in achieving efficient operation and maximum degree of accomplishment in all phases of the work of the Bureau, and keeps the Director informed on important developments. The incumbent's accountability for the success of consumer protection programs and projects encompasses responsibility for the full range of factors that affect program and project accomplishment, including establishing goals of the consumer protection mission, determining the resources needed to accomplish that mission, and ensuring the most efficient use of available funds and staff. In consultation with the Associate Directors and Regional Directors, the incumbent establishes case priorities, makes workforce allocations, and executes a continuous evaluation of mission goals and objectives. The incumbent monitors progress toward organizational goals and makes appropriate adjustments to such goals, including: monitoring work status through formal and informal means to evaluate progress toward objectives; assessing overall effectiveness, efficiency, and productivity; and identifying, diagnosing, and consulting on problem areas related to implementation and goal achievement and making decisions on alternative courses of action.

The Deputy Director is a primary factor in ensuring that overall Bureau resources are used and applied in the most effective manner consistent with resources and budget determinations for consumer protection activities. Together with the Bureau Director, Associate Directors, and Regional Directors, the incumbent plans, organizes, coordinates and evaluates the work of a very large staff of attorneys, investigators, paralegals, other professionals, and supporting technical legal and clerical personnel. The incumbent administratively and professionally directs and oversees through Associate Directors and Regional Directors the work of staff in accomplishing consumer protection goals and objectives. In directing the consumer protection work, the Deputy Director assesses policy, program, and project feasibility; determines program goals and develops implementation plans; structures the work of the organization to promote effective work accomplishment; and sets effectiveness, efficiency, and productivity performance requirements and management/internal control standards.

The Deputy Director coordinates work of the Bureau with that of other units within the Commission and with other government agencies having similar or related problems, such as the Food and Drug Administration, Department of Justice, Consumer Financial Protection Bureau, Federal Communications Commission, Department of Agriculture, and US Postal Service. The incumbent provides briefings or testifies before Congressional committees as required on proposed legislation or on trade regulation problems which are under Congressional scrutiny, and makes recommendations to the Chairman and the Commission as to the need for additional legislation to cope with problems which cannot be fully addressed under existing rules or statutes.

The incumbent may advise the Commission with regard to all phases of the consumer protection situations arising in connection with the practices under consideration, especially as to the nature of relief available to the Commission in special competitive situations through the use of litigation. The Deputy Director makes recommendations to the Director and Commissioners with regard to the various complex phases of litigation for which the incumbent is responsible and keeps the Commissioners advised of trends in the consumer protection area.

  • Background investigation (Public Trust) is required.
  • You will serve a one-year probationary period unless you have previously completed the probationary period in the Senior Executive Service (SES).
  • The individual selected will be required to file an Executive Branch Personnel Financial Disclosure Report (OGE Form 278) in accordance with the Ethics in Government Act of 1978.
  • This position is designated as eligible for remote work. If selected, you must be approved for remote work prior to onboarding in accordance with FTC's Workplace Flexibilities Policy.

Qualifications

QUALIFICATIONS:
As a basic requirement, applicants must demonstrate technical and professional competence as described in the Mandatory Professional Credentials/Technical Qualifications section below and executive leadership capabilities as described in the Executive Core Qualifications (ECQs) of the SES listed below. Typically, experiences of this nature will have been gained at or above the GS-15 grade level or its equivalent in federal service, or with state or local government, private industry, or nongovernmental organizations.

If you are a current career member of the SES, are eligible for reinstatement into the SES, or have completed an SES Candidate Development Program and have been certified by the Office of Personnel Management's (OPM) Qualifications Review Board (QRB), you can apply for competitive and/or noncompetitive consideration. For competitive consideration, you must submit a resume and written statements addressing the Mandatory Professional Credentials/Technical Qualifications, ECQs, and other applicable qualifications. For noncompetitive consideration, you must submit your resume, written statements addressing the Mandatory Professional Credentials/Technical Qualifications, and other applicable qualifications. Written statements addressing the ECQs are not necessary for noncompetitive consideration. You must also provide documentation of QRB certification (i.e., SF-50 showing career SES status or OPM-issued SES qualification certificate).

MANDATORY PROFESSIONAL CREDENTIALS AND TECHNICAL QUALIFICATIONS:

Mandatory Professional Credentials: The position requires graduation from an accredited law school and current possession of a bar membership which permits the practice of law in the United States. Proof of this should be provided via copy of transcript or diploma.

Mandatory Technical Qualifications (should not exceed two pages per qualification):
1. The position requires demonstrated experience applying the Federal Trade Commission Act and a wide range of statutes and rules related to consumer protection.

2. Demonstrated executive-level experience managing all aspects of litigation, including analyzing complex legal issues and questions of litigation strategy, reviewing pleadings and memoranda, and supervising and reviewing the work of attorneys and other staff.

EXECUTIVE CORE QUALIFICATIONS: All applicants must submit written statements describing accomplishments that would satisfy the ECQs. You must respond to all ECQs and address each one separately, as failure to do so will result in a rating of 'ineligible' for the position. A good competency-based qualifications statement should address the following elements for each ECQ: (a) the goal, problem, or activity and its challenge, (b) the context or environment in which the activity took place, (c) specific actions you took to address the challenge, and (d) the results or impact of the activity. Each accomplishment should be clear, concise, and emphasize your level of responsibilities, the scope and complexity of the programs you managed, and the results of your actions. You are strongly encouraged to review the Guide to Senior Executive Service Qualifications. The ECQ statement, addressing all five ECQs, may be no longer than ten pages.

ECQ 5 - Building Coalitions: This ECQ involves the ability to build coalitions internally and with other federal agencies, state and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals.
