Help

At the entry level of this position, you will:

- Provide legal advice, perform legal research, prepare legal documentation, and provide policy recommendations regarding the Clean Air Act and other environmental statutes.

- Participate in civil administrative or judicial litigation activities.

- Perform a full range of affirmative enforcement and litigation activities arising under the Clean Air Act and other environmental statutes.

- Work closely with the EPA Office of Enforcement and Compliance Assurance, U.S. Department of Justice, and state partners to represent EPA in administrative and judicial enforcement proceedings.

- Work on interdisciplinary teams that include environmental scientists, engineers and specialists.

- Draft Agency determinations, proposed regulations, and Federal Register Notices.

- Perform negotiation, informal dispute resolution, and assist with regional representational work in enforcement and other matters in both administrative and judicial forums.

- Perform specialized team-work, including on Freedom of Information Act requests, records management and other government information law matters.

- Work closely alongside others with different viewpoints and social identities from your own (including race, religion, national origin, age, sex, sexual orientation, gender identity, disability and genetic information).

When entering a Federal job at a grade level lower than the highest promotion potential level, you may be promoted to more complex duties and work more independently, as your career progresses.  NOTE:  Career ladder promotions are not automatic, and all eligibility and qualifications requirements must be met in order to progress to the next grade level.

You must self-certify annually and in writing that you hold an active bar membership.

If you are selected, you will be required to complete a Confidential Financial Disclosure form within 30 days of your first day of employment and annually thereafter.

This position is designated as High Risk and requires a background investigation. Unless an appropriate background investigation is already on record with the Office of Personnel Management, you must undergo a background investigation. All conditions of the pre-employment security process must be met before an official letter of employment can be issued with a report for duty date.

If you are selected, you may be required to complete a one-year trial period.

Qualifications

In addition to the educational requirements, you must meet the minimum grade-specific qualifications as described below:

To qualify for the GS-13 level, you must have at least one year of specialized experience equivalent to the GS-12 level defined as providing legal counsel on technical and legal issues, developing and presenting policy and legal recommendations, briefing managers, working with other EPA offices, the U.S. Department of Justice, state and tribal partners and outside counsel in administrative and judicial enforcement proceedings. In addition, you need to have experience in counseling clients on complex technical and legal issues arising under the Clean Air Act and/or experience in or knowledge of the preparation and review of actions under the Clean Air Act.

To qualify for the GS-14 level, you must have at least one year of specialized experience equivalent to the GS-13 level defined as providing legal counsel on technical and legal issues, developing and implementing strategic enforcement response, making policy and legal recommendations, briefing senior managers, working with other EPA offices, the U.S. Department of Justice, state and tribal partners and outside counsel in administrative and judicial enforcement proceedings. In addition, you need to have experience in counseling clients on complex technical and legal issues arising under the Clean Air Act and/or experience in or knowledge of the preparation and review of actions under the Clean Air Act.

The candidate must have exceptional written and oral communication skills, strong time management skills, the ability to manage a significant case docket, and a strong interest in practicing environmental law, environmental enforcement, public service, and EPA’s mission of protecting public health and the environment.

Education

You must:

(1) possess a J.D. or LL.M. degree from an accredited or pre-accredited college or university or equivalent apprentice experience as allowed per state law; and

(2) be duly licensed and authorized to practice as an attorney under the laws of any state, territory of the United States, or the District of Columbia; and

(3) be an active member of the bar of any U.S. jurisdiction in good standing. (NOTE:  Bar membership is not required at the time of application, but you must be admitted to the bar before entry on duty.)

About the Office of Regional Counsel, Region 8: EPA’s Rocky Mountain Region (Region 8) implements and enforces federal environmental laws in Colorado, Montana, North Dakota, South Dakota, Utah, Wyoming and 28 Tribal Nations.

The Region 8 Office of Regional Counsel (ORC) represents the Region in a wide variety of legal matters, including civil and administrative cases, regulatory and permit actions, government contracts, and employment matters. Often working with the Justice Department, EPA headquarters, and state environmental agency lawyers, the office assists in the enforcement of federal air, water, hazardous waste, toxics and pesticides laws throughout the Region. The office also manages the Freedom of Information (FOIA) response process.
