Summary

About the Position: You will function as the Deputy District Counsel for the Huntington District Office of Counsel and render legal advice, assistance and support to the District Commander, Deputy Commander, and other Division Chiefs on a range of legal issues. In addition to supervising the District's two (2) paraprofessionals, the Deputy District Counsel serves as the Deputy Ethics Counselor and the primary legal advisor on Regulatory and Environmental matters.

Duties

Help
  • Function as full deputy to the District Counsel and, as such, participates thoroughly in the accomplishment of overall office activities and objectives.
  • Review work of subordinates, determining legal sufficiency, conformance to policy, and general soundness of legal conclusions.
  • Provide primary legal support for accomplishment of the Corps? regulatory permit program under the River and Harbor Act of 1899 and Section 404 of the Clean Water Act of 1972, and manage litigation pertaining to the Corps regulatory program.
  • Render legal advice, assistance, and services on environmental and cultural resource compliance issues pertaining to civil work projects, programs, and activities conducted by District staff under federal laws and regulations.
  • Furnish legal advice and assistance in fiscal law and procurement matters from contract formation through dispute resolution.
  • Provide litigation assistance to the United States Attorney and Department of Justice attorneys responsible for trying litigation.
  • Function as the District Deputy Ethics Counselor.

In order to qualify, you must meet the education and experience requirements described below. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student; social). Applicants will be evaluated to determine if they meet the minimum qualification requirements and on the extent to which their application shows possession of the following knowledge, skills and abilities (KSAs) associated with the position.

KSAs:

KSA #1: Deputy District Counsel: Ability to work effectively in a team environment, especially with other attorneys, to develop legal approaches cover full range of U.S. Army Corps of Engineers mission, balancing and coordinating the assignment of roles and responsibilities, while achieving positive results. Supervisory competency in leading teams, reviewing work of attorneys and paraprofessionals, and problem-solving.

KSA #2: Regulatory Law and Environmental Compliance: Knowledge, skills, abilities, and experience with respect to federal laws, regulations, and policies related to regulatory matters and environmental compliance, including the River and Harbor Act of 1899, the Clean Water Act, NEPA, cultural resources, historic preservation, other applicable environmental laws, and related implementing regulations. Reviews public notices for adequacy and compliance with applicable regulations. Manages regulatory litigation, oversees Administrative Record production in APA matters, liaison with federal and state regulatory agencies concerning pending litigation.

KSA #3: Fiscal Law/Procurement Law: Knowledge, skills, abilities, and experience with respect to federal laws, regulations, and policies related to fiscal law, appropriations, and civil works authorities, applicable laws and regulations covering federal acquisition, including contract formation and contract administration of construction, service, supplies, and architect-engineer contracts, contractor labor-management relations, procurement fraud and fiscal law.

KSA #4: Ethics: Knowledge, skills, abilities, and experience with respect to federal ethics regulations, including Department of Defense Standards of Conduct, the Joint Ethics Regulation, and familiarity with mandatory financial disclosure programs including the Office of Government Ethics confidential (OGE 450) and mandatory (OGE 278) disclosure programs.

KSA #5: Oral and Written Communication: Ability to communicate clearly and persuasively, both orally and in writing, with diverse clients and constituencies on varied and complex topics.

Education

The following minimum qualification requirements must be met before applicants are eligible for further consideration.

Education: Applicants must have successfully completed a full course of study in a school of law accredited by the American Bar Association(ABA) and have the first professional law degree (LLB or JD).

Bar Membership: Applicants must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.

Experience: Applicants must have three or more years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. Graduation from an ABA-Accredited Law School in the top 25% of the class or an advanced law degree such as an LLM may substitute for one year of the required professional legal experience.

FOREIGN EDUCATION: If you are using education completed in foreign colleges or universities to meet the qualification requirements, you must show the education credentials have been evaluated by a private organization that specializes in interpretation of foreign education programs and such education has been deemed equivalent to that gained in an accredited U.S. education program; or full credit has been given for the courses at a U.S. accredited college or university.
