Duties

Help

As an Attorney-Adviser (General), GS-13-0905-13-01, you will:

  • Acts as a legal adviser and attorney for the state/territory National Guard, responsible for assisting in the formulation of state/territory legal policy pertaining to prevention of sexual assault, sexual harassment, and domestic abuse, while serving as the special legal advisor to the Adjutant General, the Office of Staff Judge Advocate (OSJA), Commands SHARP and SEEM programs. Primary coordinator and advisor in the OSJA pertaining to military justice/adverse actions that are initiated against alleged offenders. Serves as the primary point of contact for outside entities and stakeholders, including Special Victims' Counsel, Defense Services, the SARC and the SEEM Manager preventing future harm to victims by ensuring the proper procedures are implemented and followed and that justice and adverse actions are administered properly.
  • Acts as expert legal counsel for medical evaluation boards (MEB), physical evaluation board process, and lines of duty (LOD) for Army and Air personnel. Responsible for legal counsel to the Adjutant General and Commanders on any public or private sector collaborations to develop definitions for essential primary prevention competencies for leaders and performs legal review of any associated policy and guidance for evaluation guidance as to prevention.
  • Responsible to advise on the legal, factual, and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted, sensitive and emotionally charged issues relating to sexual crimes, harassment, domestic violence/abuse, and to the prevention and response of sexual crimes, harassment, and domestic violence/abuse. Serves as legal counsel to Adjutant General and Commanders on legislation, regulation, or guidance as to creating protective environments and promoting healthy social norms specific to military communities, which can include advising on any collaborations with local, state, and federal partners such as county health departments, State health departments, schools, the CDC, Department of Education, other government agencies, academia, and/or other industry that can ensure that the military can evaluate and assess the impact of their community-level prevention strategies both in the short and long-term.
  • Responsible for legal counsel to the Adjutant General and Commanders on any public or private sector collaborations to develop definitions for essential primary prevention competencies for leaders and performs legal review of any associated policy and guidance for evaluation guidance as to prevention.
  • Responsible for advising on any policy or guidance regarding the removal of restrictive policies on sensitive data collection in order to advance primary prevention of sexual harassment and sexual assault in the military. Conducts outreach on behalf of the organization to legal entities and organizations, including State Bar, and statewide civilian organizations who support victims, and conducts training to the organization and leaders regarding legalities/requirements in addressing prevention and response of special crimes, domestic violence, and sexual assault.
  • Serves as legal counsel and advises on any legislation, policy, or guidance providing for an authorization and funding for NGB to conduct recurring National Guard unit inspections and staff assistance visits for prevention and oversight of sex crimes, harassment, and domestic violence/abuse. Advises Adjutant General and Commanders on any legislation, laws, policy, or guidance related to victims' rights or survivor facilitation and healing, including but not limited to Crime Victims' Rights Act (CVRA), Article b6 of UCMJ, and the "No Wrong Door" approach.
  • Responsible for advising on any fiscal contracts that address DoD policy and programs aimed at integration and implementation of the prevention of sexual harassment, sexual assault, victims' right, workplace violence, domestic violence, family abuse, and suicide, which can include but not limited to robust primary prevention research, data collection and analysis for implementation and evaluation of prevention activities, functional and community collaboration with stakeholders who can inform prevention, policy development within DoD and Service headquarters, program management, leadership advisement, program activity and implementation oversight, and continuous evaluation, adaptations, and evaluations . Advises on any fiscal contracts that facilitate instituting a pilot program to link Service members with resources and support, and the procurement of any virtual platforms that provide support to Service members, as to sexual harassment, sexual assault, victims' rights, workplace violence, domestic violence, family abuse, and suicide.

Qualifications

General Experience:

All series personnel must be competent at the next higher level before being eligible for that level. An applicant must have a validated understanding of the basic principles and concepts of the occupational series and grade.

Specialized Experience:

Do you have at least 24 months of Specialized education, experience or training in the following:

  • Working as a professional Attorney Advisor.
  • Specified experiences that prepared the applicant to successfully perform the Judge Advocate duties and responsibilities, with the required competency level, as defined by the applicable position description.
  • The basic principles and concepts of the occupational series and grade for dual status technician appointment to the GS-0905 Attorney-Adviser program positions.
  • The Air National Guard programs and organizational mission requirements.
  • Providing legal interpretation and guidance to ANG managers and senior leaders on United States Code Title 32 § 709, National Guard Program.
  • The ability to recognize and identify complex constitutional, state-federal, and military-civilian jurisdictional issues frequently associated with the organization and administration of the Title 32 National Guard and articulate them in the appropriate forum or context.
  • Providing legal interpretation and guidance to managers and senior leaders on 10 United States Code, and the state equivalent to the federal Uniform Code of Military Justice.
  • Conducting legal research in connection with cases pending administrative hearings, trials before courts of original jurisdiction, or arguments in appellate courts.
  • Addressing legal questions referred by administrative officials of the employing agency, such as questions concerning the interpretation and application of statutes, rules, and regulations as they pertain to contracts, claims, or other legal instruments involving private business, state, local, national, or foreign governments.
  • Researching, cross-checking information, and interpreting data to obtain accurate and relevant information.
  • Negotiating with those who resist responding or cooperating, due to such issues as organizational conflict, competing objectives, or limited resources.

Education

Army/Air National Guard Officers:

For entry into the Army National Guard JAG Corps/Attorney-Adviser, it is mandatory to have a Bachelor of Laws or Juris Doctor degree in law issued by an ABA-accredited law school; and must be admitted to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia.

Applicant must be an attorney licensed in good standing in the state of New Jersey (and able to produce a certificate of good standing) as well as a current member of either the New Jersey Army or Air National Guard.
