This position serves as the Senior Debarring Official for the Agency's Suspension and Debarment Program, located in the Office of Grants and Debarment (OGD). The suspension and debarment program is a government-wide program centrally administered in OGD, and under general regulations governed by the Office of Management and Budget (OMB). The incumbent is the sole person authorized to render an individual or organization ineligible to participate in direct Federal contract or approved subcontracts, or to participate in some Federally assisted activities. The incumbent is the sole official to whom the Administrator delegated their statutory authority to reinstate facilities Congress has determined by law to be ineligible for criminal misconduct under the Clean Water and Clean Air Acts.

Specific duties of the position include:

  • Advising the Administrator on suspension and debarment matters, recommending the formulation and promulgation of policy for the suspension and debarment program in the Agency.
  • Serving as the Administrator's advisor on suspension and debarment policy and interpretation of policies and procedures and how they affect the program offices upon implementation.
  • Issuing notices of suspension and debarment to individuals and/or organizations who have been recommended for suspension and/or debarment by the Suspension and Debarment Division.
  • Rendering case decisions by issuing written Determinations and Orders upon completion of fact-finding and mitigation hearings or written submission.
  • Reviewing and signing negotiated settlement/compliance agreements recommended by the Suspension and Debarment Division in settlement of suspension or debarment cases.
  • Participating in or serving on other inter-agency program coordination or regulatory development committees, as well as serving as the Agency representative to sections of the American Bar Association, such as the Governments Contracts Law, Administrative Law, Section and the Subcommittee on Suspension and Debarment.
  • Performing supervisory and management duties as they relate to staff involved in the Suspension and Debarment decision-making process.

The Ethics in Government Act, P.L. 95-521 requires the applicant selected for this position to submit a financial disclosure statement, OGE-278, prior to assuming the SL position, annually, and upon termination of employment.

You must self-certify annually and in writing that you hold an active bar membership.

This position is designated as High Risk and requires a background investigation. Unless an appropriate background investigation is already on record with the Office of Personnel Management, you must undergo a background investigation. All conditions of the pre-employment security process must be met before an official letter of employment can be issued with a report for duty date.

If you are selected, you may be required to complete a one-year trial period.

To ensure compliance with an applicable preliminary nationwide injunction, which may be supplemented, modified, or vacated, depending on the course of ongoing litigation, the Federal Government will take no action to implement or enforce the COVID-19 vaccination requirement pursuant to Executive Order 14043 on Requiring Coronavirus Disease 2019 Vaccination for Federal Employees. Therefore, to the extent a Federal job announcement includes the requirement that applicants must be fully vaccinated against COVID-19 pursuant to E.O. 14043, that requirement does not currently apply. Federal agencies may request information regarding the vaccination status of selected applicants for the purposes of implementing other workplace safety protocols, such as protocols related to masking, physical distancing, testing, travel, and quarantine.

Qualifications

In addition to the education requirements below, you must meet the following requirements:

To qualify for this SL position, you need to have at least one year of full time experience equivalent to the GS-15 level defined as evaluating suspension and debarment cases to recommend issuing notices of suspension, notices of proposed debarment, or taking other appropriate administrative action to enforce contractor and grantee/participant responsibility for procurement activities. 

You will be evaluated on the mandatory Technical Qualifications listed in this announcement. See the Evaluations section of this announcement. 

Education

You must (1) possess a J.D. or LL.M. degree from an accredited or pre-accredited college or university or equivalent apprentice experience as allowed per state law, (2) be duly licensed and authorized to practice as an attorney under the laws of any state, territory of the United States, or the District of Columbia, and (3) be an active member of the bar of any U.S. jurisdiction in good standing.

Additional information

Time in grade requirements do not apply to SL/ST positions.

This position is excluded from provisions of the Interagency Career Transition Assistance Program (ICTAP).

Selection under this appointment authority does not confer civil service competitive status.

If you are selected, travel, transportation, and relocation expenses will not be paid by EPA. Any travel, transportation, and relocation expenses associated with reporting to work in this position will be your responsibility.

Technical Qualifications (TQs) - Mandatory - Limited to two pages per factor - Failure to address these factors individually will result in your application being disqualified.

TQ1. Demonstrated litigation experience in Federal or state civil and/or administrative proceedings.

TQ2. Demonstrated experience representing Federal agencies, state agencies, or other parties/litigants in cases involving parallel proceedings and coordination of criminal, civil, and administrative remedies (including suspension and debarment).

TQ3. Demonstrated experience conducting investigations and practicing criminal, civil, administrative, and/or business law.

TQ4. Demonstrated experience applying statutes and regulations related to environmental law, federal contracts law, grants and other federal assistance activities.
