Duties

Help

You will:

- Resolves highly legal complex questions which arise under all laws, regulations, lawsuits, enforcement actions, executive orders and other administrative actions involving major Federal statutes affecting the Agency's programs.

- Research legal questions relating to statutes, regulations, executive orders, case law, policy and guidance for enforcement and/or counseling matters in administrative or judicial actions or any other issue affecting Agency programs.

-  Provide legal advice and policy recommendations on Regional enforcement and/or counseling matters. This involves responding to legal questions concerning the interpretation and application of statutes and regulations or other issues as they affect private business, local, state, tribal or national matters.

- Draft or assist in the preparation of major legal correspondence, briefing packages, notices (including notices of violation), information requests, subpoenas, administrative orders, litigation referrals and other counseling or enforcement documents and review those documents for legal sufficiency and consistency with Agency positions, policy and guidance.

- Be responsible for coordinating the work of less experienced attorneys and technical experts, review all major work to assure that written materials and oral presentations are clear, precise and of high quality.

To ensure compliance with an applicable preliminary nationwide injunction, which may be supplemented, modified, or vacated, depending on the course of ongoing litigation, the Federal Government will take no action to implement or enforce the COVID-19 vaccination requirement pursuant to Executive Order 14043 on Requiring Coronavirus Disease 2019 Vaccination for Federal Employees. Current Bar membership in good standing/law license is required. You must self-certify annually and in writing that you hold an active bar membership.

If you are selected, you will be required to complete a Confidential Financial Disclosure form within 30 days of your first day of employment and annually thereafter.

This position is designated as High Risk and requires a background investigation. Unless an appropriate background investigation is already on record with the Office of Personnel Management, you must undergo a background investigation. All conditions of the pre-employment security process must be met before an official letter of employment can be issued with a report for duty date.

If you are selected, you must complete (or have already completed) a 1-year supervisory or managerial probationary period.

Upon acceptance of an initial appointment to a supervisory or managerial position with the EPA, you agree to complete all elements of the EPA Successful Leaders Program. This development program is designed to enhance leadership skills and abilities and meet the Agency's goal of providing new leaders with the skills and tools you need to be successful.

Qualifications

You must be admitted to practice before the highest court of a state, U.S. territory, the District of Columbia, or the Commonwealth of Puerto Rico; and must maintain active status as a member of the bar of one of these jurisdictions.

In addition, the following specialized training or experience is desired: Knowledge and experience with statutes and governing regulations arising under CERCLA, FOIA, OPA as well as RCRA, EPCRA, CWA, TSCA and CAA. The ability to conduct nuanced legal analysis of statutes, regulations, and case law, along with an analysis of relevant policy and guidance for enforcement and for the interpretation and implementation of remediation statutes; ability to work independently; excellent research and writing skills; superior oral and written communication skills; ability to build effective relationships with regional and headquarters offices; and the ability to work with diverse persons and perspectives. This position supervises work performed by attorneys and staff in ORC's Superfund Branch while building and maintaining effective working relationships with ORC, regional, headquarters, and state managers.

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional, philanthropic, religious, spiritual, community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

About the Office of Regional Counsel, Region 6: The Office of Regional Counsel, Region 6 is a fast paced, high profile practice in environmental law. There are approximately 60 attorneys from diverse backgrounds employed in the Region who provide legal advice and support on environmental matters arising out of Arkansas, Louisiana, New Mexico, Oklahoma, Texas, 66 Tribal Nations, and numerous environmental justice communities. The efforts of the attorneys in Region 6 significantly contribute towards EPA’s overall mission of protecting human health and the environment.
