Help

As a senior special counsel in the Chief Counsel's Legal Guidance Office No. 2, your work assignments may include any of the following tasks:

  • Being the primary point of contact for all IM CCO issues related to crypto and digital asset matters, including coordinating with other divisions, offices, and FinHub, and serving as a resource and knowledge leader on all such matters.
  • Providing legal and interpretive guidance on both digital asset and other issues under the Investment Company Act and the Investment Advisers Act, and identifying and providing advice with respect to the interaction between those Acts and novel and emerging financial structures such as decentralized finance, the status of digital asset and other companies as investment companies and investment advisers, and more.
  • Assuming independent responsibility for providing guidance on a variety of significant digital asset and non-digital asset projects, from the initial, formative stages through the completion of the matter including acting as or assisting the principal attorney in charge of projects with complex and difficult legal issues that may substantially impact the activities of the Commission.
  • Researching and analyzing the legal issues, drafting substantive legal documents including memos and correspondence and/or reviewing the research, analysis and written documents of staff attorneys.

  • This position is in the collective bargaining unit.
  • Due to COVID-19, the SEC is currently in an optional telework posture. This position is eligible to request telework in accordance with the SEC 's telework policy.

Qualifications

All qualification requirements must be met by the closing date of this announcement.

Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. Qualifying education must have been obtained from an accredited college or university recognized by the U.S. Department of Education.

BASIC REQUIREMENT: All applicants must possess the following

  • J.D. or LL.B. degree --AND--
  • Active membership of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico. (Note: proof of bar membership will be required before entry on duty.

MINIMUM QUALIFICATION REQUIREMENT: In addition to meeting the basic requirement, applicants must also meet the minimum qualification requirement.

SK-16: Applicant must have four (4) year(s) of post J.D. work experience independently identifying legal issues, providing legal analyses, providing legal solutions/recommendations, and preparing legal documents such as contracts, dispositions, pleadings and motions, which also includes three (3) years:
  1. Providing legal advice, researching and providing legal interpretation of statutes, and implementing regulations; and
  2. Interpreting and applying the provisions of the Investment Advisers Act or Investment Company Act, as well as the Securities Act and Exchange Act.
