The Chief Counsel will lead a dynamic team that is responsible for issuing no-action letters, interpretive letters and other guidance under the Investment Company Act of 1940 (Investment Company Act), the Investment Advisers Act of 1940 (Investment Advisers Act) and their related rules, and under other federal securities laws that affect the asset management industry. The office reviews and analyzes applications requesting exemptive orders under the Investment Company Act and the Investment Advisers Act, and drafts the Commission releases related to those applications. Within the Chief Counsel's Office, the IM Liaison Office assists the Division of Enforcement on investigations that involve potential violations of the Investment Company Act and the Investment Advisers Act, and assists the Division of Examinations with questions about compliance with the Investment Company Act and the Investment Advisers Act that arise in the course of their examinations. The Chief Counsel's Office also assists foreign regulators in legal questions relating to the U.S. securities laws that apply to investment companies and investment advisers.
Typical duties include:
MINIMUM QUALIFICATION REQUIREMENT: In addition to meeting the basic requirement, applicants must also meet the minimum qualification requirement.
SO-01: Applicant must have four years post-J.D experience independently identifying legal issues, providing legal analyses, providing legal solutions/recommendations, and preparing legal documents, such as memos, disclosures, and regulatory filings, which also includes at least three years:
