This position is located in the Office of Inspector General (OIG) for the Export-Import Bank of the United States (EXIM). The OIG was was organized in 2007 as an independent office within EXIM to support its mission and goals by promoting the economy, efficiency, and effectiveness in the administration of EXIM programs and operations and to prevent and detect fraud, waste, and abuse in such programs and operations. The Inspector General Act of 1978, 5 U.S.C. App., as amended (the IG Act), charges the Inspector General (IG) with the responsibility for conducting and supervising audits, investigations, inspections, and evaluations. The Inspector General keeps the President and Chair of EXIM and Congress fully and currently informed about problems and deficiencies relating to the administration of those programs and operations.

The incumbent serves as a Senior Attorney-Advisor and, in that capacity, is responsible for providing the Inspector General (IG), senior managers, supervisors, and other non-supervisory staff with policy advice, and with expert legal counsel and services needed to carry out the statutory responsibilities imposed by the IG Act.

At the full performance level, duties include, but are not limited to:

  • Advises on all legal issues pertaining to audits, investigations, inspections, evaluations, and other activities involving EXIM programs and operations and other sensitive matters as directed by the IG or designee.
  • Provides legal support to the IG on matters of special concern, advising on questions of law and administrative policy involved in the operations of the OIG, and in its contacts with EXIM, contractors, representatives of federal, state, or local governments, EXIM program participants, and the general public.
  • Acts as a principal attorney in charge of recommending policies and developing procedures and regulations to implement new or amended legislation for the employing agency. Is responsible for ensuring that these policies, procedures, and regulations are consistent with the intent of laws, and are administratively sound, efficient, and economical in operation.
  • Reviews legal cases for agencies responsible for the conduct of litigation in Federal courts to determine whether to recommend prosecution. Considers the weight of evidence, importance of the case, necessity of uniform application of the law throughout the United States, cost of litigation, and other considerations that bear on the advisability of instituting a lawsuit.
  • Prepares memoranda of fact and law and recommends whether prosecution should be undertaken.
  • Serves as a principal legal adviser to the IG or designee with respect to the legal aspects of the formulation, coordination, revision and execution of OIG policies and programs. Advises on contracts and agency ethics.
  • Trains OIG professionals on the elements of criminal offenses, the collection, evaluation and preservation of evidence necessary for successful prosecution, and the substantive and procedural rules that cover the conduct of criminal investigations.
  • Advises and works with other government attorneys in prosecutions, litigations, and administrative enforcement actions involving major OIG cases.
  • Serves as the OIG's Whistleblower Protection Coordinator, in accordance with the IG Act

Qualifications

Basic Requirements:

  • A graduate of a law school accredited by the American Bar Association and have at least five (5) years experience as a practicing attorney.
  • Be a current member of a bar with a valid license to practice law in a state, territory of the United States, District of Columbia, or commonwealth of Puerto Rico.

Specialized Experience (Credit for Specialized Experience on resume must reflect 40 hours/Full-time per week for each period of work):

GS-15: You must have one (1) year of specialized experience that has equipped you with the particular knowledge, skills, and abilities to successfully perform the duties of the position, and that is typically in or related to the work of the position to be filled. To be creditable, specialized experience must have been equivalent to at least the GS-14 level in the Federal Government. Specialized experience includes:
  • Experience serving as an attorney providing expert and timely legal advice on the conduct of federal audits, investigations, inspections, evaluations, and other matters relevant to the mission of an Office of Inspector General;
  • Experience independently planning, organizing, and conducting work, rendering legal advice and opinions on a wide range of complex and difficult legal and policy issues;
  • Experience performing comprehensive legal research and analysis, and preparing written memoranda, advisory opinions, and other legal documents in a clear, concise, and factual manner; and
  • Experience delivering briefings and presentations on legal issues and positions to senior level officials and personnel within a federal agency or department.
Education cannot be substituted for experience at the GS-15 grade level.
