The following are the duties of this position at the full working level.

WHAT DOES A COMPETENT AUTHORITY ANALYST (APMA TEAM LEADER) DO?

This position seeks tax professionals (lawyers, accountants, or economists) who will perform the duties of a Team Leader within the Advance Pricing and Mutual Agreement program (APMA). APMA is a unit of Treaty and Transfer Pricing Operations (TTPO) and houses the portion of the office of the U.S. Competent Authority that deals with transfer pricing issues. TTPO is a practice area within the IRS' Large Business and International division. Incumbents possess substantial skill in the area of international tax provisions relating to transfer pricing under section 482 of the Internal Revenue Code and the regulations thereunder and advanced knowledge of relevant provisions in U.S. income tax treaties (e.g., Articles 7, 9 and 25) and the Organization for Economic Cooperation and Development (OECD) Transfer Pricing Guidelines. The major responsibilities include

  • Analysis, development, negotiation, and conclusion of advance pricing agreements (APAs) and the resolution of double tax cases arising from transfer pricing adjustments.
  • Reviews Advance Pricing Agreement (APA) requests and taxpayer requests for assistance in obtaining relief from double taxation to determine if such requests comply with procedural guidelines.
  • Performs a balanced and critical analysis of taxpayer and treaty partner proposals and performs due diligence to ensure that the facts and circumstances of the taxpayer's case are sufficiently understood to arrive at a legally supportable determination.
  • Evaluates, analyzes, and develops the positions of the United States with respect to complex transfer pricing issues and other international tax issues.

Incumbent is also expected to work with and/or lead other IRS tax professionals for these purposes.

  • To ensure compliance with an applicable preliminary nationwide injunction, which may be supplemented, modified, or vacated, depending on the course of ongoing litigation, the Federal Government will take no action to implement/enforce the COVID-19 vaccination requirement pursuant to Executive Order 14043 on Requiring Coronavirus Disease 2019 Vaccination for Federal Employees.   • May be eligible for telework based on IRS policy. If you are in a telework eligible position, you may be directed to temporarily telework on a full-time basis due to COVID 19. Employees must be within a 200-mile radius of their official assigned post-of-duty (POD) while in a telework status. Once normal operations resume, employees may be directed back to the office to perform the duties of their position. Telework eligibility does not guarantee telework; employees must meet and sustain IRS telework eligibility requirements and supervisor's approval to participate in the IRS Telework Program. As a reminder - If you are selected for a position, you are responsible for reporting to your designated POD (location) on the negotiated start date or as directed by management.
  • Must be a U.S. Citizen or National and provide proof of U.S. Citizenship. (Birth certificate showing birth in the U.S; Unexpired U.S. Passport; Certificate of Citizenship or Naturalization; or Report of Birth Abroad of a U.S. Citizen (Form FS-240))
  • Undergo an income tax verification and review of prior performance/conduct.
  • Must successfully complete a background investigation, including a FBI criminal history record check (fingerprint check).
  • Complete a Declaration for Federal Employment to determine your suitability for Federal employment, at the time requested by the agency.
  • Go through a Personal Identity Verification (PIV) process that requires two forms of identification from the Form I-9. Federal law requires verification of the identity and employment eligibility of all new hires in the U.S. These documents must be unexpired original or certified copies.

Qualifications

Federal experience is not required. The experience may have been gained in the public sector, private sector or Volunteer Service. One year of experience refers to full-time work; part-timework is considered on a prorated basis. To ensure full credit for your work experience, please indicate dates of employment by month/year, and indicate number of hours worked per week, on your resume.

You must meet the following requirements by the closing date of this announcement:

SPECIALIZED EXPERIENCE: Applicants must have one year of specialized experience at a level of difficulty and responsibility equivalent to the GS-13 level in the Federal Service. Examples of specialized experience includes: demonstrating experience in methods and techniques pertaining to the interpretation and application of U.S. transfer pricing regulations, and to analyze and provide assistance to taxpayers requesting relief from double taxation related to transfer pricing adjustments; experience with U.S. transfer pricing regulations and the OECD Transfer Pricing Guidelines; experience in applying IRS Revenue Procedures covering requests for relief and the prevention of double taxation and other policies and procedural guidelines relating to competent authority matters; and experience with the Internal Revenue Code and regulations pertaining to transfer pricing to analyze and provide assistance to taxpayers requesting relief from double taxation.
