Typical Duties Include:

  • Serving as a subject matter expert on distributed ledger technology and blockchains, mining, financing methods that do not use financial institutions as intermediaries, and crypto assets, including tokens, stablecoins, cryptocurrencies, and products providing exposure to crypto assets.
  • Acting as a legal adviser and counselor to Division leadership and staff on matters involving the specialized registration, disclosure, and reporting requirements that apply to crypto assets.
  • Performing extensive and often complex review(s) of statutes, regulations, and disclosure documents related to crypto assets.
  • Providing consultative and legal advisory services to the Division of Corporation Finance - Office of the Chief Accountant and DRP staff, including producing legal memoranda, responding to staff comments, and providing oral presentations, on questions involving crypto assets as they relate to the federal securities laws.
  • Providing interpretive guidance related to the rules governing crypto assets, including through no-action letters, interpretive letters, and responses to public inquiries.
  • Identifying emerging trends, suggesting innovative initiatives, and participating in ongoing initiatives.
  • Assisting with special projects.

  • PERMANENT CHANGE OF STATION (PCS): Moving/Relocation expenses are not authorized.
  • DIRECT DEPOSIT: All Federal employees are required to have Federal salary payments made by direct deposit to a financial institution of their choosing.
  • This position is in the collective bargaining unit.
  • Due to COVID-19, the SEC is currently in an optional telework posture. This position is eligible to request telework in accordance with the SEC 's telework policy.

Qualifications

All qualification requirements must be met by the closing date of this announcement.

Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. Qualifying education must have been obtained from an accredited college or university recognized by the U.S. Department of Education.

BASIC REQUIREMENT: All applicants must possess the following

  • J.D. or LL.B. degree --AND--
  • Active membership of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico. (Note: proof of bar membership will be required before entry on duty.

MINIMUM QUALIFICATION REQUIREMENT: In addition to meeting the basic requirement, applicants must also meet the minimum qualification requirement.

  • SK-14: Applicant must have three year(s) of post J.D. work experience as a practicing attorney, two year(s) of which includes:
  1. Drafting and reviewing filings made under the federal securities laws, with a particular emphasis on filings made under the Securities Act of 1933 and the Securities Exchange Act of 1934; and
  2. Providing legal advice or conducting legal analysis regarding the application of the federal securities laws; and
  3. Applying the federal securities laws and case law to novel products and transactions; and
  4. Providing guidance in the evaluation of complex disclosure reporting issues; and
  5. Demonstrating an understanding of products that provide synthetic exposure to underlying assets and crypto assets, including tokens, stablecoins, cryptocurrencies and products providing exposure to crypto assets, such as exchange-traded products.
