Summary

This position serves as an attorney in the Regulatory Services Division of the Office of the General Counsel (OGC).  The Office of General Counsel (OGC) provides legal counsel and advice to the Secretary of the Department of Education.  The Division is principally involved in establishing the Department's policies and procedures for the drafting, processing, and issuance of all regulatory documents.

As a General Attorney GS-905-13, you will perform the following duties;

Conducting legal research and analysis in connection with procedural and education program statutes;

Reviewing and editing regulatory documents for legal compliance with applicable statutes, executive orders, and regulations to ensure publication of well-written documents that can withstand judicial review; and

Advising Department offices on administrative law and the regulatory process.

The duties described above reflect the duties at the GS-14 level. If selected at the GS 13 level, selectee will perform similar duties with varying levels of autonomy and complexity.

Qualifications

Basic Requirements:

1. You must be a graduate from a law school accredited by the American Bar Association.

2. Proof of admission to the Bar of the highest court of a state, territory, the District of Columbia, or the Commonwealth of Puerto Rico; and current membership in such Bar as would permit the practice of law. You must be a member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico bar.

Specialized Experience for the GS-13:

 At least one year of specialized experience equivalent to the GS-12 performing two (2) of the following duties or work assignments:

1. Experience developing and applying knowledge of administrative law and agency statutes, regulations, and related materials.

2. Experience providing legal advice on administrative procedure and the regulatory process, or drafts regulatory documents in compliance with applicable statutes, executive orders, and regulations.

3. Experience reviewing and editing regulatory documents to ensure that documents are well written and comply with applicable statutes, executive orders, and regulations. 

Specialized Experience for the GS-14:

 At least one year of specialized experience equivalent to the GS-13 performing two (2) of the following duties or work assignments:

1.  Experience providing legal advice on administrative law and the regulatory process, or drafts regulatory documents in compliance with applicable statutes, executive orders, and regulations.

2.  Experience reviewing and editing regulatory documents to ensure that documents are well written and comply with applicable statutes, executive orders, and regulations. 

3.  Experience conducting legal research on topics related to administrative law or agency statutes and regulations. 

For appointment at the GS-13 or GS-14 level, the following qualification requirements are needed: Three (3) or more years of professional legal experience acquired after being admitted to the Bar. You must have one year of specialized experience commensurate with the duties and responsibilities of the position at a level close to the work of this job that has given you the particular knowledge, skills, and abilities required to successfully perform.

Telework: During the current period of mandatory telework required by the Agency’s COVID-19 response, telework will be mandatory.  When it is determined the Agency will be moving to the reopening phase, employees will be expected to physically return to the office of their official duty locations.  Telework days and any required waiting period for eligibility will be determined at that time.

Bargaining Unit: This position is not included in the bargaining unit.

Selections: Agencies have broad authority under law to hire from any appropriate source of eligibles and may fill a vacancy in the competitive service by any method authorized. We may make additional selections from this vacancy announcement within 90 days from the date the selection certificates are issued, should vacancies occur. We may also share selection certificates amongst program offices across the agency.
