The Regional Solicitor is responsible for planning, organizing, and directing the conduct of all litigation connected with the various laws administered by the Department and providing legal advisory services to the ranking Departmental officials in the San Francisco Region. In this regard, the incumbent directs a staff of approximately 28 attorneys and nine support personnel. The Regional Solicitor exercises overall direction of the Region by approving the institution of the majority of lawsuits, assigning work, evaluating work performance, providing appropriate training and assignments for the development of attorneys and support staff, developing annual budget projections and insuring that budget obligations remain within the amount allocated by the National Office and taking responsibility for all regional personnel and obligations under the Civil Service Reform Act. The incumbent provides advice and legal opinions based on comprehensive knowledge of Department policy, clear awareness of precedent setting Federal court cases in the region, and elsewhere, enforcement problems particular to various jurisdictions, and national trends in court decisions in the various program areas. The incumbent also directs the preparation of all opinions and interpretations as requested by DOL regional officials, other federal officials, employers, unions and other members of the public. The Regional Solicitor also represents the Office of the Solicitor in dealing with federal agencies outside the Department, employees and their attorneys, unions, and other groups for such purposes as clarifying the relationships, explaining Department and SOL policy, securing cooperation for Department's enforcement programs, resolving conflicts in authority between federal and state agencies. The Regional Solicitor is consulted by and serves as legal advisor and consultant to the Regional Administrators for the Wage Hour Division, the Employment and Training Administration (ETA), the Mine Safety and Health Administration (MSHA), the Occupational Safety and Health Administration (OSHA), the Office of Federal Contract Compliance Programs (OFCCP), the Employee Benefits Security Administration (EBSA), the Office of Labor-Management Services (OLMS), and other Regional Offices of the Department. The incumbent also furnishes guidance and direction to the attorney staff on the preparation for trial, and trial, in especially important and complex cases, and questions pertaining to the settlement of cases short of litigation. With the assistance of the Deputy Regional Solicitor, Associate Regional Solicitors, and Counsels, the Regional Solicitor keeps abreast of the overall productivity and morale of the offices and decides upon assignment of cases among attorneys, changes in types of cases assigned to attorneys, recommendations for promotions, awards or discipline, recommendations for additional staff and other appropriate measures.

Candidates must possess broad and progressive experience in an attorney position that involves novel and/or complex legal questions and expertise as a legal advisor/litigator. This experience must have been at a major management level (normally equivalent to the GS-15 level in the Federal government) and have at least 4 or more years of post law school experience.

Qualifications

To qualify for this position, all applicants must write a narrative in the spaces provided detailing accomplishments that would satisfy each of the ECQs and MTQs.  You must address each ECQ and MTQ separately.  If you fail to do so, your application will be rated ineligible.

In writing your responses to the ECQs, your narrative must address each ECQ separately in the spaces provided.  Each ECQ should contain at least two examples describing your experiences and accomplishments/results. Responses to ECQs must not exceed 10 pages. It is recommended that applicants draft their ECQs in a Word document first, then cut and paste into the spaces provided following each ECQ to ensure length requirements.  For additional guidance, applicants may visit the Office of Personnel Management's Guide to Senior Executive Qualifications. Applicants are encouraged to follow the Challenge, Context, Action, and Result model outlined in the guide.

MANDATORY EXECUTIVE CORE QUALIFICATIONS (ECQs):
1. 5. Building Coalitions:  This core qualification involves the ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals.

MANDATORY TECHNICAL QUALIFICATIONS (MTQs): In writing your narrative responses to the MTQs, please give examples and explain how often you used your skills, the complexity of the knowledge possessed, the level of people you interacted with, the sensitivity of the issues you handled, etc. 

1. Knowledge of relevant or comparable areas of the law as demonstrated by significant experience in federal court and/or administrative trial litigation.

2. Demonstrated ability to identify, analyze, and resolve novel and/or complex legal issues having significant policy and programmatic implications.  This includes the ability to effectively present such issues, orally and in writing.

3. Successful experience in managing and leading a legal office, component or significant team; demonstrating competencies such as effective recruitment and development of staff; efficient use of human, fiscal, informational and material resources; effective internal and external communications; problem solving; and decision making.

4. Demonstrated ability to collaborate with components across the organization as well as with other governmental agencies to produce results.

Education

Education is a requirement of this position and applicants must possess a J.D. from an accredited law school.  Documentation of an active Bar License from within the United States or its territories will be required before selection.  In addition, practicing lawyers in California must be licensed by that State Bar.  If selected for Los Angeles or San Francisco, the candidate must be or must become a member of the California Bar within 14 months of selection.
