Summary

This position provides technical health and safety staff advisory services for the District and Field offices in the administration of the Federal Mine Safety and Health Act of 1977 (P.L. 91-173, as amended by P.L. 95-164) within the Birmingham District and monitors, coordinates, or conducts District field safety work. 

This position is inside the bargaining unit.

Duties

Help

Conducts investigations of discrimination complaints filed under Section 105( c) of Public Law 95-164 by miners, representatives of miners, or applicants for employment. Conducts special investigations with respect to accident and fatality disasters after rescue and recovery operations are completed, securing evidence and maintain chain of custody, issuing violations, citations, or orders resulting from the disaster, making determinations regarding possible willful violations, and participate as necessary in civil or criminal proceedings which could follow. Conducts civil and criminal investigations under Section 110 of the Federal Mine Safety and Health Act. Conducts safety and health inspections. Issues citations and orders with the intent of accident prevention and reduction. Conducts other investigative activities as the needs dictate. Testifies at judicial hearings regarding citations and orders or withdrawal, as well as to the facts gathered during investigations initiated under Section's 105 and 110 of the act.

Qualifications

Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level,GS-11, in the Federal Service. Specialized experience is in or directly related to the line of work of the position to be filled and which has equipped the applicant with the particular knowledge, skills, and abilities to successfully perform the duties of the position.

Experience performing mine safety and health inspection, analysis and evaluation of health/safety aspects of mining industry operations and processes; or evaluation, analysis or development of agency programs. Examples of creditable experience include: direct on-site inspection; special accident investigation; development of mine safety and health standards; data analysis and evaluation of operational mine safety and health programs; special assessments; and development of industry-wide training or safety and health awareness programs. Specialized Experience is performing mine safety and health special investigations: Conducts investigations of dissemination complaints filed under Section 105( c) of Public Law 95-164 by miners, representatives of miners, or applicants for employment; Conducts special investigations with respect to accident and fatality disasters after rescue and recovery operations are completed, securing evidence and maintain chain of custody, issuing violations, citations, or orders resulting from the disaster, making determinations regarding possible willful violations, and participate as necessary in civil or criminal proceedings which could follow; Conducts civil and criminal investigations under Section 110 of the Federal Mine Safety and Health Act; Conducts safety and health inspections; Issues citations and orders with the intent of accident prevention and reduction; Conducts other investigative activities as the needs dictate; Testifies at judicial hearings regarding citations. and orders or withdrawal, as well as to the facts gathered during investigations initiated under Section's 105 and 110 of the act.

Education

There is no substitution of education for specialized experience at the GS-12 grade level.

Evaluation Factors (Competencies) - All qualified applicants will be evaluated on the following key competencies:

Problem Solving: Knowledge to apply new developments or proven theories to problems or situations not readily solvable by normally accepted methods and the skills to recognize and correct hazardous mining conditions without endangering anyone.

Interpersonal Skills: Ability to exchange information, coordinate work efforts, and implement new procedures as well as resolve problems or conflicting data and obtain compliance with established engineering criteria or provisions of The Act by skillful negotiations, influence, or motivation.

Communication Skills: Ability to communicate effectively orally in order to meet and deal with persons inside and outside MSHA, and gain support for agency programs.

Mine Safety and Health: Knowledge of enforcement activities and subsequent policies, and regulations required under the Federal Mine Safety and Health Act of 1977.

Planning and Evaluating: Knowledge of the provisions of the Federal Mine Safety and Health Act of 1977, the MSHA Inspection and Investigation Manual, the Management Information System (MCIS), MSHA's policies and procedures, the District's programs and goals, and the overall objectives of MSHA and the district to evaluate effectiveness of the district's program, degree of goal accomplishments and inspection activities.
