Duties

Help

As an attorney in the Bureau of Competition, you will perform a variety of legal duties relative to cases or legal issues of extreme difficulty. Often the work of the staff includes advisory functions related to antitrust enforcement policy under the various statutes enforced by the Commission.

More specifically, incumbents of this position will perform duties such as:

  • Conduct all phases of antitrust merger or conduct investigations. Prepare for trial and litigate or negotiate settlements in antitrust matters.
  • Make initial determinations as to whether matters should be investigated; identify legal theories and plans for preliminary investigations; obtain evidence from a variety of sources.
  • Confer with government agencies, public authorities, attorneys, businesspersons and other members of the public in order to obtain information relevant to Commission investigations and to provide them with information on matters of law, Commission procedures and policy.
  • Prepare antitrust cases for trial by securing and preparing evidence, conferring with witnesses, participating in pretrial conferences, examining and cross-examining witnesses, and drafting legal documents needed during the various stages of litigation.
  • Assist other attorneys in preparing and prosecuting the most complex cases.
  • Prepare internal documents for review by the Commission and perform special assignments as directed.

Qualifications

Minimum Requirements:
Applicants must have attained the first professional law degree (LL.B. or J.D.) from an accredited law school and be an active member in good standing of the bar of a state, the District of Columbia, Puerto Rico, or a U.S. territory. Applicants must demonstrate excellent writing skills and be able to work effectively with other people, exercise sound judgment, and exhibit a strong interest in the work of the agency.

Additional Requirements:
GS-13 Positions:
For appointments to attorney positions: active member of the bar in good standing and 24 months of legal experience after graduation from law school.

GS-14 Positions: For appointments to attorney positions: active member of the bar in good standing and 42 months of legal experience after graduation from law school.

GS-15 Positions: For attorney appointments: active member of the bar in good standing and 60 months of legal experience after graduation from law school.

The ideal candidate has experience conducting all phases of merger or conduct investigations and litigation consistent with the duties of the position(s). In addition, ideal candidates may also possess professional or educational backgrounds in economics, finance, in certain industries such as technology and healthcare, or in certain legal specialties such as intellectual property..

Please note that prior experience, whether legal and non-legal experience, gained before completing law school cannot be used satisfy the post law school experience requirement

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience

The Mergers IV Division investigates transactions involving hospitals, physicians, office supply distribution, food distribution, supermarkets, specialty retail stores, consumer goods, and casinos, among other industries. Mergers IV has been responsible for a number of recent merger challenges, including Sysco/US Foods, Staples/Office Depot, Advocate/NorthShore, DraftKings/FanDuel, Sanford/Mid-Dakota, Smucker/Conagra, Post/Treehouse, and Jefferson/Einstein.

The Anticompetitive Practices Division investigates potential anticompetitive practices in industries other than health care and digital platforms, and litigates any resulting enforcement actions. The division has recently investigated and litigated a number of cases in federal and administrative court, including FTC v. Qualcomm, In re 1-800 Contacts, In re McWane, and In re North Carolina Dental Board. Recent areas of ACP focus include high-technology industries and issues at the intersection of antitrust and intellectual property law
