Summary

This position provides advisory and technical services in the area of Employee Relations/Labor Relations (ER/LR). The employee is responsible for assignments which require analyzing and evaluating controversial and complex projects and cases, (disciplinary, adverse action and major adverse actions), developing formal and informal assistance and advice, and conducting special assignments related to the DVA employee and labor relations program at the Kansas City VA Medical Center (KCVA).

Duties

Help

Specific duties of the position include, but are not limited to the following:

  • Analyzes existing and new requirements impacting the program and provides recommendations for management's consideration
  • Utilizes a comprehensive knowledge of ER/LR & Federal personnel laws, statues, Code of Federal Regulations (CFR), case law (FLRA & MSPB & EEOC), theories, rules and resolution processes to analyze data in conjunction with KCVA's mission and recommend solutions
  • Provides guidance and consultation advice to management and employees on all aspects of complex issues relating to union grievances; unfair labor practices (ULPs); collective bargaining; labor agreement administration and interpretation; and MSPB, EEOC and FLRA adjudications
  • Advises and assists management in negotiating changes in working conditions and supplemental bargaining agreement
  • Provides situational analysis involving very sensitive, complex and controversial ER/LR matters to determine appropriate course of action
  • Develops and proposes courses of action to resolve problems and issues based on knowledge and interpretation of employee and labor-management relations, statues, administrative case law, regulations and policies. Works with all levels of management and unions to resolve grievances
  • Takes part in mediation sessions and participates in FLRA, EEOC and MSPB and its' associated entities, utilizing knowledge of the policies, procedures and precedents of relevant adjudicating bodies.
  • Analyzes grievances, complaints, and ULPs to identify systematic problems and recommend solutions.
  • Represents management at various litigation entities (i.e., MSPB, arbitration, FLRA, EEOC, etc.)
Promotion Potential: The selectee may be promoted to the full performance level without further competition when all regulatory, qualification, and performance requirements are met. Selection at a lower grade level does not guarantee promotion to the full performance level.

Qualifications

To qualify for this position, applicants must meet all requirements by the closing date of this announcement, 09/11/2019

Time-In-Grade Requirement: Applicants who are current Federal employees and have held a GS grade any time in the past 52 weeks must also meet time-in-grade requirements by the closing date of this announcement. For a GS-11 position you must have served 52 weeks at the GS-09. For a GS-12 position you must have served 52 weeks at the GS-11 level. The grade may have been in any occupation, but must have been held in the Federal service. An SF-50 that shows your time-in-grade eligibility must be submitted with your application materials. If the most recent SF-50 has an effective date within the past year, it may not clearly demonstrate you possess one-year time-in-grade, as required by the announcement. In this instance, you must provide an additional SF-50 that clearly demonstrates one-year time-in-grade.

Note: Time-In-Grade requirements also apply to former Federal employees applying for reinstatement as well as current employees applying for Veterans Employment Opportunities Act of 1998 (VEOA) appointment.

You may qualify based on your experience and/or education as described below:

GS-11

  • Specialized Experience: Applicants must have One year of specialized experience equivalent to at least the next lower grade (GS-09) in the normal line of progression for the occupation in the organization. Examples of specialized experience would typically include, but are not limited to: Human Resources work which give an understanding of labor relations and employee relations duties; possess knowledge of Drug-Free Workplace Program, Reasonable Accommodation, Management negotiating and bargaining unit partnership. OR
  • Education: Applicants may substitute education for the experience required for the GS-11 level. Educational requirements for the GS-11 level are Ph.D. or equivalent doctoral degree or 3 full years of progressively higher level graduate education leading to such a degree or LL.M., if related. (Transcripts Required) OR
  • Combination:Applicants may also combine education and experience to qualify at the GS-11 level. Combinations of successfully completed post-high school education and experience may be used to meet total qualification requirements for the GS-11, and may be computed by first determining the applicant's total qualifying experience as a percentage of the experience required for the grade level; then determining the applicant's education as a percentage of the education required for the grade level; and then adding the two percentages. The total percentages must equal at least 100 percent to qualify an applicant for that grade level. Only graduate education in excess of the amount required for the next lower grade level may be used to qualify applicants for positions at grade (Transcripts Required)

  • Specialized Experience: Applicants must have One year of specialized experience equivalent to at least the next lower grade (GS-11) in the normal line of progression for the occupation in the organization. Examples of specialized experience would typically include, but are not limited to: Human Resources work with full responsibilities in labor relations and employee relations programs; possess a full understanding of ER/LR programs; Independently developed Agency position, proposals, and strategies; Managed Drug-Free Workplace programs, Performance-Based Actions, Union Contracts, Probationary Period Actions, etc.
There is no educational substitution for the GS-12 level.

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religions; spiritual; community; student; social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

Note: A full year of work is considered to be 35-40 hours of work per week. Part-time experience will be credited on the basis of time actually spent in appropriate activities. Applicants wishing to receive credit for such experience must indicate clearly the nature of their duties and responsibilities in each position and the number of hours a week spent in such employment.

Physical Requirements: The work is primarily performed while sitting though some work may require periods of standing. The regular and recurring work of the position involves sitting at a desk, conferences, meeting, etc. and occasional visits to activity work sites. Occasional use of automobile and public conveyance may be required
