Help

As General Counsel to the Inspector General, you will serve as the principal legal advisor to the Inspector General (IG), Deputy Inspector General, and Assistant Inspectors General; provide authoritative legal analysis, research, advice, and counsel to these individuals and their staff; and represent official OIG legal positions and recommendations within the NRC and in contacts with external parties.

Specifically, you will develop and maintain comprehensive, in-depth expertise in specialized statutory and regulatory requirements governing OIG, U.S Nuclear Regulatory Commission (NRC), and Defense Nuclear Facilities Safety Board (DNFSB) activities with regard to these areas, and provide definitive legal analysis and counsel to the IG, OIG staff, Commission and Board members, senior managers, and external government officials whose activities are influenced or affected by these requirements.

You will independently develop OIG commentary on draft agency regulations addressing OIG, NRC, and DNFSB activities and obligations and provide authoritative interpretation and guidance regarding implementation and ongoing compliance. You will perform comprehensive reviews and provide commentary on existing and proposed legislation and regulations for their impact on the economy and efficiency of the administration of NRC and DNFSB programs and operations.

You will review proposed agency rules, regulations, and related documentation for legal implications or issues and provide comments, analysis, or alternative language as required; provide advice to senior OIG management regarding the potential policy or legal impact of regulatory actions; and provide guidance regarding alternative approaches or mechanisms as appropriate.

Additionally, you will review and approve IG administrative subpoenas, including those under the Right to Financial Privacy Act; advise on constitutional warnings and rights; advise on criminal and civil/administrative advisements and union rights; instruct/advise and coordinate with office and agency on Freedom of Information Act (FOIA) and Privacy Act matters, and draft final decisions; coordinate review and comment on all significant agency draft regulations/policies and Office of Management and Budget responses; review and comment on draft audit reports; advise on sensitive issues in investigative processes and reports; serve as the NRC and DNFSB Whistleblower Protection Ombudsman coordinating ongoing certification with the Office of Special Counsel and conduct/oversee ongoing educational efforts; serve as the Contracting Officer's Representative for retained counsel for personnel/EEO/special counsel matters and litigation; and coordinate with the Department of Justice for litigation.

Qualifications

Basic Requirements: You must be a current member of a Bar in good standing admitted to practice before any court of the United States, the District of Columbia, or the highest court of any State, territory, or possession of the United States.

Specialized Experience: In addition to meeting the basic entry requirements listed above, you must demonstrate at least 1 year of specialized experience that is indicative of senior level capability and an expert knowledge of, and experience interpreting and applying, general legal principles and Federal law such as the Inspector General Act of 1978, as amended, Administrative Procedures Act, Freedom of Information Act (FOIA) and Privacy Act, EEO and personnel statutes (Merit Systems Protection Board and Alternative Dispute Resolution/Mediation), Special Counsel and Whistleblowers Protection Statutes, Title 18 USC et. seq., Atomic Energy Act and Energy Reorganization Act, False Claims Act, Program Fraud Civil Remedies Act, as well as judicial decisions, government regulations, and agency and Federal case law to independently and objectively handle a wide range of matters involving complex and/or sensitive legal issues.

You must also have extensive experience in conducting legal research, preparing legal papers, and reviewing documents for legal sufficiency.

Typically, at least one year of this experience should be comparable in complexity and responsibility to the kind of work normally assigned at the grade 15 level or higher in the Federal service, or equivalent.

The ideal candidate for this position will have the following:

  1. Expert knowledge of, and experience interpreting and applying Federal criminal statutes including judicial decisions, statutes, and government regulations.
  2. Demonstrated skill in analyzing, evaluating, and developing solutions to complex and novel legal and policy issues involving personnel matters with emphasis on whistleblower protection and ethics.
  3. Expert knowledge of Federal personnel laws and Federal laws designed to protect and share information such as FOIA and Privacy Act and government contract/procurement statutes and regulations as well as civil fraud matters, including the Program Fraud Civil Remedies Act.
  4. Demonstrated advanced skills in oral and written communication sufficient to effectively convey and present complex, detailed information of a legal and/or policy nature to colleagues, peers, senior office and agency management, and representatives of other institutions, agencies, or regulatory or adjudicative bodies.
  5. Demonstrated ability to function as an organizational representative and liaison on substantive legal and policy issues, and to achieve cooperation and consensus among parties engaged in joint or parallel efforts.
  6. Demonstrated ability to conduct, support, and coordinate litigation with the Department of Justice and private counsel in Federal court, Merit Systems Protection Board, Equal Employment Opportunity Commission, and Office of Special Counsel.

Education

Applicants must be a graduate of an accredited law school with a J.D. or LL.B.

To be eligible for a 145(b) waiver you will need a favorable education verification, reference, credit, and criminal history checks. If a wavier is granted, the successful completion of a background investigation and favorable adjudication is required for continued employment. If you have resided outside the U.S. for an extended period of time, the agency may not be able to (1) grant the 145(b) waiver where the required investigation cannot be completed in a timely manner, or (2) achieve timely completion of the background investigation required for a security clearance.
