Duties

Help
  • Provides support to the Chief regarding a full range of intellectual property (IP) issues, including drafting and prosecuting patent applications, reviewing and advising on contractual IP matters, technology transfer, license rights and infringement.
  • Evaluates the technical content of invention dockets, conducts patentability searches and renders opinions on potential patentability of complex and advanced systems and concepts; drafts patent applications and prepares amendments.
  • Identifies unreported inventions through review of complex interrelated research and development work and reviews and advises on patent rights clause matters and title to inventions matters.
  • Conducts training sessions/classes/lectures for briefing of Command personnel regarding protection of Governments interests in preparation and follow-up of Government contracts, in negotiations with industry representatives and the like.
  • Studies, interprets and prepares legal opinions for all elements of the Command regarding technical data rights, computer software, patents, copyright.

  • Appointment may be subject to a suitability or fitness determination, as determined by a completed background investigation.
  • Must be able to obtain and maintain a Secret security clearance.
  • This position requires you to submit a Public Financial Disclosure Report (OGE 278) or a Confidential Financial Disclosure Report (OGE450) upon entry, and annually thereafter.
  • Business travel (temporary duty travel (TDY)) is required approximately 10% of official duty time.

The following basic qualification requirements must be met before applicants are eligible for further consideration:
1. Legal Education:
Applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (J.D. or LL.B.).
2. Bar Membership: Applicant must currently be a member in good standing in the bar of the highest court of a state, U.S. Commonwealth, U.S. Territory, or the District of Columbia.
3. U.S. Patent and Trademark Office Registration: Applicant must be a registered U.S. Patent Attorney with a license to practice before the U.S. Patent and Trademark Office.
4. Technical Education: Applicant must have successfully completed a bachelor's degree in electrical engineering. This degree requirement is due to the unique technical expertise necessary to perform the work of the position.

Required Experience: In addition to the basic qualification requirements listed above in items 1 through 4, to qualify at the GS-14 level, an applicant must have in excess of three years professional legal experience, acquired after admission to the bar, commensurate with the duties and responsibilities of the position at a GS-13 level or equivalent. Applicants will be evaluated to determine if they meet the basic qualification requirements above and on the level of competency in the following knowledges, skills, and abilities (KSAs) associated with this position. KSAs for this position are:

  • Experience drafting and prosecuting U.S. utility patent applications for electrical engineering technologies and mechanical engineering technologies
  • Ability to effectively identify issues, research applicable law, and present legal counsel recommendations
  • Knowledge of intellectual property cases, regulations, directives, and policies
  • Understanding of intellectual property law and fundamental contract law principles
  • Ability to analyze issues and apply legal principles
  • Ability to effectively communicate orally and in writing
  • Ability to work with various teams to achieve results
  • Ability to learn and apply new areas of the law
Time in Grade Requirement: If currently employed as an Attorney by the Federal Government, you must have completed one year of time-in-grade at the next lower grade level within 30 days of the closing date of the announcement, or have previously served at the same or higher grade as the grade level to which you are applying.
