Summary

The General Counsel has primary responsibility for all legal affairs of the Morris K. and Stewart L. Udall Foundation, fulfilling traditional in-house counsel functions. The General Counsel reports directly to the Foundation Executive Director, and secondarily to the Chair of the Board of Trustees. The General Counsel provides legal services to the Board, the Executive Director, and all programs.

The position requires the ability to give expert legal advice on a range of issues typically encountered by an independent federal agency (including but not limited to the enabling legislation for the Foundation and U. S. Institute, appropriations law, administrative law, personnel rules, records management, federal contract law (FAR), and the Freedom of Information and Privacy Acts) and provide counsel that consistently promotes responsible and ethical conduct in furthering the agency mission. The incumbent serves as the agency's Designated Ethics Officer and as the agency's official responsible for furthering the EEO program. The ideal candidate will possess extensive federal experience including former positions as federal general counsel.

The incumbent provides legal advice to the Udall Foundation's Board of Trustees and staff on a wide range of applicable federal laws (including the enabling legislation for the Foundation and U.S. Institute, appropriations law, administrative law, personnel rules, records management, contracts, and the Freedom of Information and Privacy Acts). Provides legal advice on complex and high-level issues related to mediations and other types of conflict resolution efforts, including questions about confidentiality protections, open meetings requirements, and underlying legal requirements as necessary.

  • Analyzes factual issues and perform legal analyses based on research and experience with statutes, judicial, and administrative opinions, policies, and practices in both the government and private sectors, as well as review of contract or agreements between the Udall Foundation and individuals, organizations, or institutions, government and private.
  • Oversee compliance with a variety of laws applicable to the activities of federal agencies.
  • Provides guidance in the interpretation of applicable appropriation laws and advises the
  • Chairman and the Executive Director on legal issues concerning the agency's budget, debt collection efforts, interagency agreements, fee structures, and other fiscal policy issues.
  • Review or develop legislation, regulations and policy guidance, and assist in preparation of agency budgets.
  • Incumbent provides expert advice in connection with financial audits and fiscal laws.
  • Represent the Foundation in meetings and communications with congressional staff, attorneys at other federal agencies, high ranking officials, and on interagency committees and projects.

Qualifications

  • The incumbent must demonstrate superior oral and writing skills as well as strong research and interpersonal skills, and good judgment.
  • Exhibit the ability to work in a supportive and professional manner with other staff, support staff and client agencies.
  • The position requires independent professional judgment, a problem-solving approach to the agency's needs, and skills in analyzing, discussing and providing oral and written counsel, on complex legal arguments, in a representative capacity, in a manner that aids the recipient in understanding the issues, options and recommended courses of action.
  • A J.D. degree from an accredited law school and an active membership with the bar and five to ten (10) years' federal experience in: appropriations law, administrative law, personnel rules, records management, contracts, and the Freedom of Information and Privacy Acts.
