Summary

This position is located in the Department of Defense Office of Inspector General (DoD OIG). As a Supervisory Attorney (ADR Specialist - Whistleblower Reprisal) you will be responsible for supervising and providing overall direction and guide ADR attorneys acting as third party neutrals assisting parties to resolve whistleblower reprisal complaints. The Supervisory Attorney will not represent or advocate for either party in the process.

This is an Excepted Service position. Any appointment made under the provisions of this announcement is excepted from the competitive civil service and may require the incumbent to serve a two year trial period. An applicant receiving such an appointment does not acquire competitive civil service status.

Help

As a Supervisory Attorney (ADR Specialist - Whistleblower Reprisal) GS-0905-14, your typical work assignments may include the following:

  • The incumbent serves as a mediator and expert on legal implications and implementation of matters arising under the Administrative Dispute Resolution Acts of 1990 and 1996 and the Alternative Dispute Resolution Act of 1998.
  • Serves as a neutral professional under the confidentiality provisions of the ADRA and other governing authorities to assist parties in reaching resolution of disputed matters related to complaints where whistleblowers allege that they have suffered reprisal for making disclosures protected by law.
  • Incumbent conducts interviews with complainants and other complaint intake procedures to determine whether complaints, supplemented by complainant interviews, constitute prima facie complaints of reprisal.
  • Initiates contacts with principal parties to the dispute, DoD Components or Contractor staff and/or management and other individuals having knowledge of the facts involved in a problem or dispute, obtains information pertinent to the situation, studies legal and policy precedents, and prepares recommendations for the involved parties that are accepted as authoritative.
  • Participates in the design and implementation of training programs and other activities to ensure the capability of Agency attorneys, investigator staff, and management to effectively use ADR processes and retain neutral professionals.

Position has been designated as Special Sensitive; the individual selected is required to obtain and maintain a Top Secret/SCI security clearance.

Incumbent is required to submit to urinalysis to screen for illegal drug use prior to appointment and is subject to random drug testing for the duration of service with Department of Defense (DoD) OIG. Organizational entities with the DoD are not required to conduct drug testing for DoD civilian employees moving by transfer or reassignment from one DoD Testing Designated Position (TDP) to another TDP with no break in service within the DoD, unless deemed appropriate on a case-by-case basis by the gaining Component.

U.S. Citizenship is required for this position.

Permanent Change of Duty (PCS-Relocation) expenses WILL NOT be paid.

If you have not previously successfully completed a trial period with the Federal Government in a similar position, you will be required to serve a two year trial period.

Requires less than 20% of temporary duty travel (TDY).

Recruitment incentives WILL NOT be authorized.

Incumbent is required to complete a Financial Disclosure Statement at time of appointment and annually and to inform supervisor or any conflict of interest whenever such conflict has been identified.


Incumbent must be an active member, in good standing, of the bar of the highest court of a state, U.S. Commonwealth, U.S. Territory, or the District of Columbia, and be permitted to engage in the practice of law.

Incumbent must adhere to the DoD Standards of Conduct.

Federal employees currently serving in the Competitive Service must acknowledge that they will voluntarily leave the Competitive Service by accepting an offer of employment in the Excepted Service.

Interagency Career Transition Assistance Program (ICTAP) does not apply to Excepted Service positions.

Lifting case files weighing up to 50 pounds is required.

Requires occasional exposure to uncomfortable conditions in work facilities.

All Attorney (GS-0905) appointments under the Schedule A appointing authority for Attorneys are required to complete a two year trial period.

Qualifications

Basic Qualifications Requirements: To meet the basic requirements, you must meet all of the following:

  1. Possess a J.D. degree from a law school accredited by the American Bar Association.
  2. Be an active member, in good standing, of the bar of the highest court of a state, U.S. Commonwealth, U.S. Territory, or the District of Columbia, and be permitted to engage in the practice of law.

Specialized Experience: Applicants must have 52 weeks of specialized experience at the GS-13 level or equivalent under GS or another pay system that demonstrates experience includes applying the principles of and in matters under the Administrative Dispute Resolution Acts of 1990 and 1996 and the Alternative Dispute Resolution Act of 1998.

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student; social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

Applicants who have held a non-temporary General Schedule (GS) position within the last 52 weeks must meet the Time in Grade Restriction.

Education

There is no substitution of education for experience at this level.

  • Knowledge of whistleblower statutes and regulations, Freedom of Information Act and Privacy Act, and DoD Administrative and Investigative policies, procedures, techniques and practices.
