This position has promotion potential to GS-12. Promotion Potential: There is no obligation to provide future promotions to you if you are selected. Future promotions are dependent on your ability to perform the duties at a higher level, the continuing need for an employee assigned to the higher level, and supervisory approval.

The Regional Offices are responsible for planning, directing, and administering a program of enforcement to ensure maximum compliance throughout the geographical jurisdiction of the Office with the Employee Retirement Income Security Act of 1974 (ERISA) and the criminal provisions of the United States Code as they relate to employee benefit plans.

Help

GS-9: Plans, conducts, and coordinates civil and criminal investigations or reviews of small single or multi-employer plans or service providers. Participates in meetings and conferences with plan officials and their legal and financial representatives.

GS-11: Plans, conducts, and coordinates civil and criminal investigations or reviews of moderate size single or multi-employer benefit plans, service providers, trust departments, and other financial entities having relationships and conducting transactions with the plans. Initiate and arrange for meetings, conferences, and discussions with plan officials, service providers, and their legal and financial representatives to explain the purpose and scope of investigation, ERISA requirements and EBSA policy and procedures, and conduct formal interviews. Examine and analyze employee benefit plan financial records, trustee meeting minutes and other plan records, employee benefit plan operating procedures to determine compliance with plan documents and ERISA, Form 5500 annual reports with financial statements and audit reports prepared by plan's accountant and fidelity bonding to determine coverage and adequacy in accordance with ERISA. Prepares comprehensive and well-documented investigative reports. Participate with higher graded investigators, in the negotiation of corrective actions with plan officials, fiduciaries and their representative to secure monetary restitution and other remedial actions. Works with the legal staff of the Department's Office of the Solicitor (SOL) and the Department of Justice in preparing cases for civil litigation and criminal prosecution and in developing documentary evidence.

Spanish Language Fluency Required: This position requires fluency in both the English and the Spanish languages; applicants should be prepared to document their ability to read, write, and speak the Spanish language. Applicants who are otherwise qualified must satisfactorily complete an interview to demonstrate their language proficiency in order to be considered for appointment.

Qualifications

GS-9: One (1) year of specialized experience equivalent to the GS- 07 in the Federal service (but not limited to Federal service) as defined below:

GS-11: One (1) year of specialized experience equivalent to the GS-09 in the Federal service (but not limited to Federal service) as defined below:

Specialized experience is work experience that equipped the applicant with the particular knowledge, skills and abilities to perform successfully the duties of the position, and that is typically in or related to the work of the position. To be creditable, specialized experience must have been equivalent to at least the next lower grade level in the normal line of progression for the occupation in the organization.

GS-9 Examples of qualifying work experience include: experience as a compliance inspector, analyst, planner or investigator whose work related to the field of employee benefit plans, and/or Federal and/or state financial regulatory statutes; experience conducting financial audits using conventional auditing techniques in the fields of finance, banking, insurance, securities, employee benefits.

GS-11: In addition to the examples of specialized experience shown above for the GS-9 at the GS-11 level your application resume should also demonstrate knowledge of ERISA laws and regulations or those of similarly complex Federal or State financial regulatory programs.

Education

GS-9: A master's or equivalent graduate degree or two (2) full years of progressively higher level graduate education leading to such a degree or LL.B. or J.D., if related.

GS-11: Ph.D. or equivalent doctoral degree or 3 full years of progressively higher level graduate education leading to such a degree or LL.M., if related.
