Duties

Help
  • Provides expert, authoritative legal advice to the CYBER Brigade Commander on CYBER and intelligence activities and operations.
  • Evaluates complex factual issues related to every aspect of the CYBER Brigade operations for legal sufficiency to support the command’s mission.
  • Represents the command and serves as an advisor to the Commander on civil and criminal litigation involving CYBER and intelligence activities conducted by the CYBER Brigade.
  • Conducts comprehensive legal reviews of draft regulations, policy directives, operational concepts and operational activities in order to resolve impediments to the command’s ability to lawfully execute its mission.
  • As required, serves as a trail attorney and agency representative for matters before the Merit Systems Protection Board (MSPB) and the Equal Employment Opportunity Commission pertaining to the CYBER Brigade and its civilian employees.
  • Represents the command in all matters and inquiries from all regulating and oversight bodies to include the Army Staff, Congressional and Executive Intelligence Oversight Committees.
  • Provides legal advice and guidance on the full spectrum of civilian personnel management and administration.

  • Designated Key Position: This position has been identified as being a Key Position under the provisions of AR 690-11, Use and Management of Civilian Personnel in Support of Military Contingency Operations.
  • Appointment may be subject to a suitability or fitness determination, as determined by a completed background investigation.
  • Two year trial/probationary period may be required.
  • In accordance with Change 3 to AR 600-85, Alcohol and Drug Abuse Prevention and Control Program, individual must successfully pass a urinalysis screening for illegal drug use prior to appointment and periodically thereafter.
  • Must be willing to undergo and successfully complete a counterintelligence-scope polygraph examination with No Deception Indicated (NDI) on a pre-appointment and periodic basis.
  • Must be able to obtain and maintain a Top Secret security clearance based on a single scope background investigation (SSBI) with eligibility for Sensitive Compartmented Information (SCI).
  • Must be a member in good standing of the bar of any state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.
  • Requires temporary duty (TDY) travel worldwide for periods of up to five days per month or longer if necessary (approximately 25%).
  • All INSCOM employees may be subject to extended TDY or worldwide deployments during crisis situations to perform mission essential functions as determined by management.
  • Must be able to obtain and maintain access to NSA facilities and networks.
  • Overtime/shift work may be required.
  • Designated Mission Essential: Must must be able to remain on duty or make every effort to report to duty on-time during emergency and/or crisis situations.

Qualifications

Applicants will be evaluated to determine if they meet the minimum qualification requirements and on the extent to which their applicant shows possession of the following knowledge, skills and abilities (KSAs) associated with the position.

  • Ability to analyze and problem-solve a wide variety of legal issues related to cyber activities. Knowledge of the federal laws, executive orders, statutes, regulations and procedures concerning the conduct of cyber and intelligence activities.
  • Knowledge of federal and/or DOD and Army civilian personnel laws and the ability to litigate sensitive cases before the equal employment opportunity commission and merit system protection board.
  • Knowledge of federal and/or department of the Army Administrative Law to include statutes, regulations, and case law related to the Freedom of Information Act (FOIA), Privacy Act (PA), administrative investigations, fiscal law, federal acquisition law, ethics, standards of conduct, executive orders and regulations.
  • Ability to write clear and concise legal documents.

VETERAN'S PREFERENCE INFORMATION: There is no formal rating system for applying veteran's preference to attorney appointments in the excepted service; however, the Department of Army considers veteran's preference eligibility a positive factor for attorney hiring. Applicants eligible for veteran's preference must include that information in their cover letter or resume and attach supporting documents (e.g., DD Form 214, Certificate of Release or Discharge from Active duty) to their submissions. Although the point-preference system is not used, applicants eligible to claim a 10-point preference must submit a Standard Form (SF) 15, Application for 10-point Veteran Preference, and supporting documentation required for the specific type of preference claimed. The following minimum qualification requirements must be met before applicants are eligible for further consideration:
  • EDUCATION: An applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD).
  • BAR MEMBERSHIP: Applicant must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.
  • EXPERIENCE: Applicant must have 3 or more years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position.
  • Graduation from an ABA-Accredited Law School in the top 25% of the class or an advanced law degree such as an LLM may substitute for one year of the required professional legal experience.
